Galimba, Council Member Council District 6 SUBJECT: Proposed Amendment to Bill No. 153; an Ordinance Amen ing Chapter 4, Article 4, Section 4-4-26, of the Hawaii County Code 1983 (2016 Edition, as Amended), Relating to Animals. Please see below a proposed amendment to Bill No. 153. The proposed amendment is shown in Ramseyer format with respect to the contents of Bill No. 153; material to be deleted is bracketed and stricken, and material to be added is underscored. A copy of the new draft of this bill that would result if this proposed amendment were to be adopted is intentionally omitted dire to the limited scope of the proposed amendment. Bill No. 153 is amended by amending subsection (a) of Section 4-4-26 of the Hawaii County Code 1983 (2016 Edition, as amended) to read as follows: "(a) Any person disturbed by a noisy dog shall make a reasonable attempt to advise the owner or custodian who keeps such dog of this fact[-.], unless safety may be a factor. Reasonable attempts for notification include by letter, email, visit to the owner or custodian, or any other legal method. if the person disturbed by a noisy dog is unable to notify the owner or custodian of the noisy dog, or after notifying the owner or custodian, the nuisance is not abated, the person disturbed by the noisy dog may then notify the appropriate enforcement agency."
