Copy of letter to Sidney Fuke (planning consultant to
applicantj, from Planning Director Duane Kanuha, dated
October 3, 1990, acknowledging receipt of his letter
requesting an extension of time in which to submit the
final plat in conformance with Section 23-67,
Article 5, of the Subdivision Control Code, and
informing that Leinaala Keakealani Leightner shall be
addressed as the applicant, as her father, Robert
Keakealani, the original applicant, has passed away.
Informs, a one-year extension of time until
December 27, 1991, as requested, is granted, and that
if the applicant requires an additional extension of
time to the conditions of approval of Ordinance No.
89-103, the request, accompanied by a $100 filing fee,
shall be submitted to his office for consideration by
the Council.
Further, informs that the submittal of the annual
progress report, which was due on July 12, 1990,
pursuant to Condition G, has lapsed, and requests that
the report be submitted within 30 days of receipt of
his letter and may be incorporated as part of the time
extension request. States, should they not hear from
them within the specified time frame, their office may
initiate procedures to rezone the subject property to
its original or more appropriate designation, pursuant
to Condition H.

Copy of letter to Olen Zirkle, Jr., Vice President of
Western Farm Credit Bank, Sacramento, California, from
Planning Director Duane Kanuha, dated October 10, 1990,
confirming the progress of the Hamakua Planning effort
to date. States a preliminary conceptual land use plan
for the planning area has been completed and initial
discussions have been conducted with key organizations
in the Hamakua community. Further, states that before
the end of October, the Hamakua Planning Committee will
begin to finalize a draft document which will also
include more specific land use allocation than the
broad scenarios presented at this stage of the planning
process.
Res. 244: Endorses the Hamakua Sugar Company's land use concepts
as presented to the Planning Committee at its meeting
of October 10, 1990, to serve as a planning and
regulatory guide for all future County land use
decisions affecting certain areas identified by the
State/County "Steering Committee", whose primary
objective was to develop a land use plan that would
enhance the prospects for the continued operation of
the sugar industry in the Hamakua area.
Further, that all development proposals affected by the
plan shall still be subject to the same standards of
review relative to land use procedural requirements,
community participation and infrastructural impacts and
obligations thereto; and that to facilitate the
implementation of the plan and its objectives, the
Council, upon request of the affected property
owner(s), may consider the adoption of a development or
other similar agreement which articulates the types and
levels of infrastructural obligations associated with
the development of the affected properties.

Copy of letter to Max Yuki, Mauna Lani Resort, Inc.,
from Planning Director Duane Kanuha, dated October 12,
1990, acknowledging receipt of their annual progress

Comm. 2052: report, in compliance with Condition R of the
(Cont'd) referenced ordinances.
Informs that Condition H of the subject ordinances
requires, in part, that "a minimum of 53 acres of land
shall be set aside for park and recreational purposes
for the petitioner's total proposed development
encompassing 3,200 acres"; however, their files
indicate that only 3.2 acres park site has been
provided for park and recreational purposes. States
the areas referenced in their report relative to the
35 acres within 4 historic preserves and 21 acres in
fishponds passive park area cannot be credited to the
park requirement; therefore, states an additional
49.8 acres of land for park and recreation purposes
needs to be set aside for compliance with Condition H.
Res. 242-90: GENERAL PLAN AMENDMENT (SUISAN CO.. LTD. - WAIAKEA)
Directs the Planning Director to initiate a General
Plan Amendment to redesignate the properties identified
as TMK: 2-2-33: parcels 11, 19, 20 and 4 from Medium
Density to Industrial Area.
