Hawaii County Code §16-6 establishes that the Kona CDP Action Committee shall provide ongoing guidance and advocacy to advance the implementation of the CDP goals, objectives, policies, and actions. The Kona CDP Action Committee met on Tuesday, June 25, 2024, at the West Hawaii Civic Center. Included on the agenda was a discussion regarding the Kona Three, LLC Rezone Application (PL-REZ-2022-000033). The AC voted unanimously to provide their written testimony collectively, identified as Communication 2024-23, attached. Under consideration was Agenda Item 42: Testimony to County Council regarding the Kona Three LLC Rezone Application — Discussion and decision -making on whether the Action Committee will provide testimony to County Council. Following a two-hour discussion, including public testimony, the Action Committee approved the motion to provide testimony to the Hawai' i County Council regarding the Kona Three LLC application's inconsistencies with the goals adopted within the Kona CDP Ordinance. Regarding Cultural Resources, the Kona CDP Action Committee supports the recommendations from the Cultural Resources Commission in their letter to the Leeward Planning Commission dated July 17, 2023 (see letter excerpt attached). The Committee found that the Kona Three LLC application does not reflect the goals adopted within the Kona CDP Ordinance, specifically the following: Transportation: "Objective TRAN-6 Concurrency. To manage the timing of growth so as to avoid overloading the arterial system." The Action Committee believes the Kona Three LLC application conflicts with the Kona CDP's Concurrency Objective. The CDP anticipates a balance between development growth and regional infrastructure improvements. New development accessing Queen Ka`ahumanu Highway, especially in that vicinity, may further overload the arterial system and compromise the safety and quality of life for Kona residents. 2. Environmental Resources: "Objective ENV-1: Managing Impacts. The Kona CDP Action Committee is concerned that the Kona Three, LLC application does not adequately address the potential impacts of flood corridors that may affect adjacent properties. In addition, the AC suggests that the County provide consideration to the following Kona CDP Policy recommendation: "policy ENV-1..7: Flood Corridors. Collectively, the FIRM floodplains and the planned flow ways may serve as open space amenities, such as linear parks and/or greenbelts between urbanized areas." The Kona CDP Action Committee would like to express our appreciation to the members of the Hawaii County Council for working with the AC to achieve the goals adopted within the Kona Community Development Plan. Sincerely, ChalloYo*g( u19, 202u N57� Charles Young, Chairman Kona Community Development Plan Action Committee Attachment: CRC Letter Excerpt Barbara Del4ranco, Chairperson Leeward Planning Commission Page 2 July 17, 2023 In accordance with Hawaii County Code Section 2-44 and the Rules of Practice and Procedure for the Cultural Resources Commission, the review, recommendations, and opinions on the project are as follows: After considering the cultural and historic resources on the property including the undocumented Holualoa Trail and petroglyph and how it relates to Holualoa, as well as other possible significant cultural historic features not previously identified, the CRC's opinion of the project's impact to historical assets is that this project will likely have a substantial impact on historic assets. The following Cultural Resources Commission's opinions and recommendations are hereby transmitted for your consideration in execution of the action Before you. 1. Due to the historic and cultural significance of the property, the CRC recommends that the property be preserved in perpetuity. In the event that this is infeasible, the CRC recommends the following conditions be required to be completed prior to any development permit approvals by the County. a. In order to be integrated into the development design, the CRC recommends further documentation of lineal descendant and kama`aina knowledge of the natural and cultural resources of the project area, inclusive of trails. b. That the applicant, in consultation with the community, amend the current development plan to include larger open space areas that more sensitively integrate and protect the natural, historical, and cultural Features of the landscape, including trails and other cultural sites, as well as natural features of the terrain such as drainage channels, and native plants.
