Re: Proposed Amendment to Bill No, 169, Draft 2; AN ORDINANCE AMENDING
ORDINANCE NO. 02-131, WHICH AMENDED ORDINANCE NOS. 97-99, 94-34,
93-26, 91-96, 90-62, 88-4, 84-42, AND 84-23, WHICH RECLASSIFIED CERTAIN
LANDS FROM UNPLANNED (U) TO MULTIPLE -FAMILY RESIDENTIAL — 5,000
SQUARE FEET (RM-5) AND SINGLE-FAMILY RESIDENTIAL — 15,000 SQUARE
FEET (RS-15) AT HOLUALOA 1 AND 2, NORTH KONA, HAWAVI, COVERED BY
TAX MAP KEYS: 7-6-021:004, 009-013, AND 015-017.
Please see below a proposed amendment to Bill No, 169, Draft 2. The proposed amendment is
shown in Ramseyer format with respect to the contents of Bill No. 169, Draft 2; material to be
added is underscored. Due to the limited scope of this amendment, a draft copy of the new draft
of this Bill that would result if this proposed amendment were adopted is not attached.
SECTION 1 of Bill No. 169, Draft 2, is amended by adding a new Condition X to be
appropriately inserted and to read as follows:
"X.. ................As. represented by the Applicant, the Applicant shall record a Declaration that institutes a
covenant, condition, and restriction upon the subject„property that prohibits any dwelling
unit within the ro'ect site to be used as a time shares short-term vacation rentals or other
form of short-term transient accommodation. This Declaration shall be recorded with the
State Bureau of Conveyances prior to the issuance of Final Plan Approval for any
dwelling llit(S) to be constructed on the sub.iect.property,"
2. Conditions X, Y, Z, and AA of Bill No. 169, Draft 2 are renamed as Conditions Y, Z,
AA, and BB, respectively.
