AN ORDINANCE REPEALING ORDINANCE NO. 12 132, WHICH AMENDED SECTION 25-8-33 (CITY OF HILO ZONE MAP), ARTICLE 8, CHAPTER 25 (ZONING CODE) OF THE HAWAI‘I COUNTY CODE 1983 (2005 EDITION), BY CHANGING THE DISTRICT CLASSIFICATION FROM SINGLE-FAMILY RESIDENTIAL – 10,000 SQUARE FEET (RS-10) TO MULTIPLE-FAMILY RESIDENTIAL – 3,000 SQUARE FEET (RM-3) AT WAIĀKEA, SOUTH HILO, HAWAIʻI, COVERED BY TAX MAP KEY: 2-2-038:017. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I: SECTION 1. Ordinance No. 12 132 which amended Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the Hawai‘i County Code 1983 (2005 Edition), is hereby repealed in its entirety and the subject property shall be classified back to its original zoning district. SECTION 2. Section 25-8-33, Article 8, Chapter 25 (Zoning Code) of the Hawaiʻi County Code (2016 Edition, as amended), is amended to change the district classification of property described hereinafter as follows: The district classification of the following area situated at Waiākea, South Hilo, Hawai‘i, shall be Single-Family Residential – 10,000 square feet (RS-10): Beginning at the northwest corner of this parcel of land, the coordinates of said point of beginning referred to Government Survey Triangulation Station “HALAI” being 6,022.35 feet South and 8,213.17 feet East, and running by azimuths measured clockwise from true South: 238º 10' 237.00 feet along Lots 15-A and 15-D (Grant 8356 to Frank Amaral); 328º 10' 180.00 feet along Lots 3-B and 3-A (Grant 10697 to Mrs. Shizue Okino); 58º 10' 237.00 feet along Lots 17-B and 17-A (Grant S-15256 to Peter K. Mehau Jr., et al.); 148º 10' 180.00 feet along Parcel 141 (Kinoʻole Street Road Widening) to the point of beginning and containing an area of 42,660 square feet, more or less. All as shown on the map attached hereto, marked Exhibit "A" and by reference made a part hereof. SECTION 3. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 4. This ordinance shall take effect upon approval.
