HomeMy WebLinkAboutORD 2024-054 2022-2024 • ZY of M,' COUNTY OF HAWAI`I + �": '� t STATE OF HAWAI`I • • •17'E OF•N.,i' BILL NO. 168 ORDINANCE NO. 24 54 • AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE V, CHAPTER 2, OF THE CHARTER OF THE COUNTY OF HAWAII (2022 EDITION),RELATING TO THE COST OF GOVERNMENT COMMISSION. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to propose an amendment to the County Charter providing the members of the Cost of Government Commission with.a longer timeframe to more thoroughly and carefully accomplish their work as directed by the Charter. SECTION 2. Article V, chapter 2, section 5-2.2 of the Charter of the County of Hawai`i (2022 Edition)is amended to read as follows: "Section 5-2.2. Cost of Government Commission. For the purpose of carrying out the policy set forth herein the mayor with the approval of the council shall appoint a cost of government commission consisting of nine members. Each of the nine council districts shall be represented by a resident appointed from that district. The managing director shall be an ex-officio members of the commission. The office of the mayor shall provide administrative and clerical services to the commission. Each commission shall: (a) Prepare and submit to the mayor a request for an appropriation for the operation of the commission. (b) Study and investigate the organizations and methods of operations of all departments, commissions,boards, offices and other instrumentalities of all branches of the county government and determine what changes, if any,may be desirable to accomplish the policy set forth herein. (c) Be authorized to secure directly from any depattuient, commission,board, office or any other instrumentalities of all branches of the county government or from any individual officer or employee of the county, information, suggestions, estimates, and statistics necessary to carry out its duties. (d) Submit a report of its findings and recommendations to the mayor, managing director and council not later than [eleven] twenty months after its appointment." SECTION 3. Article V, chapter 2, section 5-2.3 of the Charter of the County of Hawai`i (2022 Edition)is amended to read as follows: "Section 5-2.3. Term of Commission. The commission members shall be appointed to terms starting [one y ar] eighteen months after the beginning of the term of the mayor, and lasting [eleven] twenty-two months." SECTION 4. Charter material to be repealed is bracketed and stricken.New Charter material is underscored. When revising, compiling, or printing these charter provisions for inclusion in the Charter of the County of Hawai`i, the reviser need not include the brackets, bracketed material, or underscoring. SECTION 5. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 6. Upon adoption of this ordinance, the Council, by appropriate resolution, shall provide that this amendment be submitted to the electorate of the County of Hawai`i for approval in the 2024 general election. SECTION 7. This charter amendment proposed in this ordinance shall take effect upon approval by a majority of voters voting on this legislation in the 2024 general election, as duly certified.
