SUBJECT: County Council Initiated Bill No. 134 (PL-CCI-2024-000007)
Amendment to Chapter 25 (Zoning), Article 2, Section 25-2-42, of the
Hawaii County Code 1983 (2016 Edition, As Amended) Relating to
Amendments Initiated by Property Owners and Other Persons
The Windward Planning Commission (Commission), at its duly held public hearing on July 1,
2024, considered the County Council Initiated Bill No. 134, amending Chapter 25, Article 2,
Section 25-2-42, of the Hawaii County Code 1983 (2016 Edition, as amended) relating to
amendments initiated by property owners and other persons. The Commission voted to forward
an unfavorable recommendation of Bill No. 134 to the County Council as recommended by the
Planning Director.

SUBJECT: County Council Initiated Bill No. 134 (PL-CCI-2024-000007)
Draft 2, Amendment to Chapter 25 Article 2, Section 25-2-42 of the Hawaii
County Code 1983 (2016 Edition, As Amended) Relating to Amendments
Initiated by Property Owners and Other Persons
The Leeward Planning Commission (Commission), at its duly held public hearing on June 20,
2024, considered the County Council Initiated Bill No. 134, amending Chapter 25, Article 2,
Section 25-2-42, of the Hawaii County Code 1983 (2016 Edition, as amended) relating to
amendments initiated by property owners and other persons. The Commission voted to continue
the above -referenced request to the next scheduled public hearing to allow the Planning Director
and Councilmembers Inaba and Evans to continue discussions in order to reach consensus about
how to amend Bill 134. The continued hearing will begin at 9:30 a.m. on Thursday, July 18,
2024, in the County of Hawaii West Hawaii Civic Center, Council Chambers, Building A
74-5044 Ane Keohokalole Highway, Kailua-Kona, Hawaii.

The Leeward Planning Commission (Commission), at its duly held public hearing on July 18,
2024, considered the County Council Initiated Bill No. 134, Draft 2, amending Chapter 25,
Article 2, Section 25-2-42, of the Hawaii County Code 1983 (2016 Edition, as amended)
relating to amendments initiated by property owners and other persons.
The Commission heard Bill No. 134, Draft 2 at their public hearing on June 20, 2024, and voted
to defer action on the bill to allow the Planning Director and Councilmembers Inaba and Evans
to continue discussions in order to reach consensus about how to amend Bill No. 134, Draft 2. In
an email dated July 17, 2024, Councilmember Inaba provided suggested amended language for
Bill No. 134, Draft 2 to the Commission.
The Commission voted to forward a favorable recommendation of Bill No. 134, Draft 2 to the
County Council incorporating Councilmember Inaba's suggested amendment and further
amended the language related to including properties in the report within a one -quarter mile
radius of the property being rezoned. The Commission recommends Bill No. 134 be amended as
follows:
The director shall prepare a report identifying properties within a distance consistent with
Hawaii County Code, Section 25-2-4 (Notice to Property Owners and Lessees of Record of
Pending Application) of the subject property that have undergone a change of zone, any
ordinance(s) relevant to the change of zone, and the status of those change of zone ordinance(s).
The report shall also identify properties within the same distance that can be subdivided under

their current zoning and specify the potential number of parcels that can be created for each
property.
The Commission disagreed with the Planning Director's unfavorable recommendation. The
