SUBJECT: Proposed Amendment to Bill No. 123, Draft 3; an Ordinance Amending
Chapter 19, Article I and Article 13, Chapter 23, Article 9, and Chapter 25,
Article 1, Article 2, Article 5, and Article 6 of the Hawaii County Code
1983 (2016 Edition, as Amended), Relating to Ohana Dwelling Units,
Transmitted herewith is a proposed amendment to Bill No. 123, Draft 3. The proposed
amendment is shown below in Ramseyer format with respect to the contents of Bill No. 123,
Draft 3; material to be deleted is bracketed and stricken, and material to be inserted is
underscored.
SECTION 10 of Bill No. 123, Draft 3, which amends chapter 25, article 6, division 3, of the
Hawaii County Code 1983 (2016 Edition, as amended), is amended by amending section 25-6-36
to read as follows:
"Section 25-6-36. [Repealed.] Density limit.
Accessory dwelling units shall be restricted to a maximum of three Der building site
except, where a building site is permitted to have more than one primary dwelling, one
accessory dwelling unit shall be allowed for each Drimary dwelling authorized by the
applicable zoning regulations."
Due to the limited scope of this proposed amendment, a copy of the new draft of this bill
that would result if the proposed amendment were adopted is not attached.
