Proposed Amendment to Bill No. 134, Draft 2: an Ordinance Amending Chapter
25, Article 2, Section 25-2-42 of the Hawaii County Code 1983 (2016 Edition, as
Amended), Relating to Amendments Initiated by Property Owners and Other
Persons.
Transmitted herewith is a proposed amendment to Bill No. 134, Draft 2. The proposed
amendment is shown below in Ramseyer format with respect to the contents of Bill No. 134,
Draft 2; material to be deleted is bracketed and stricken; material to be inserted is underscored. A
copy of the new draft of this bill that would result if this proposed amendment were adopted is
intentionally omitted due to the limited scope of the amendment.
SECTION 1 of Bill No. 134, Draft 2, which amends chapter 25, article 2, section 25-2-42 of the
Hawaii County Code 1983 (2016 Edition, as amended) by amending subsection (c), is amended
by amending paragraph (4) to read as follows:
"(4) The director shall prepare a report [identifying all buildings elud ng existing
buildings that are legally per-: ittede a ,struete ] on surrounding properties of
which any portion is within one -quarter mile of the perimeter boundary of the
subject property[. The diffeete-f , and further shall transmit the report to the
commission and the council prior to their respective consideration of the change of
zone sought by the application. The report shall include;
A All changes of zone and amendments thereto ranted to surroundin
properties,
B A description of the status of each condition not et completed for any such
change of zone, and the remaining time provided for the performance thereof;
and
(C) The maximum number of lots into which each surrounding property may be
subdivided under its district classification."
