Aloha Chairperson Kimball,
Bill 121 has several points that need consideration before moving forward. Anyone
currently renting unhosted for 30 to 180 days will immediately become illegal. As seen in
Honolulu with Bill 41 in 2023 when it was overturned, this change is an unconstitutional
taking. This will result in expensive litigation, which Hawaii County will likely lose.
Anyone who rents a home long term to an on -site host and rents an attached ohana short
term will immediately become illegal with no path to register for a permit. Only
homeowners will have the right to rent an ohana to help make ends meet. Also, anyone
renting a tiny home or other unique structure will face fines up to $10,000 and forced
closure if caught.
Anyone without adequate off-street parking will be denied a permit, and website owners
listing two or more units will face excessive reporting requirements and fines up to
$10,000 per day for non-compliance.

identified to necessitate this legislation.
Please wait for the outcome of the economic impact study before proceeding with Bill 121.
