Subject: Written Testimony in Opposition of Bill 122
Aloha Council Members,
I am writing in opposition to the current proposed Bill 122. We live on the Big Island and our qhJ1dren
attend school. in Waimea. We started our Bed & Breakfast plans in 2021 and applied to HawdillCounty to
be a Bed & Breakfast and received Planning Approval in December 2022 and didn't get our building
permits issued until. November 2023. We are currently in process of getting our final building inspections
now so that we may apply to receive our Certificate of Occupancy prior to this bill. passage. However, if
this bill passes as it is currently written prior to us receiving our Certificate of Occupancy we will lose
hundreds of thousands of dollars we have invested into this project and years of work we have done to
become a Bed & Breakfast and it would have very negative implications for our family and any other local
family in the same situation.
If the county decides they are going to advance Bitt 122 it would be appreciated if the Council
Members would consider the current situations of local residents and constituents in the midst of a
project and amend Bitt 122 to include that any project that has already received Planning Approval
woutc! be Honored and grandf athered even if their Certificate of Occupancy hasn't been issued yet
and not let this bill wipe away years of work (and hundred of thousands of dollars) for local
residents that are caught during the timing of this bill. We are almost 3 years into the project since
we initiated and paid for our project plans and do not feet it is right for Bill 122 passing to have such
a negative implication on us or any residents. We feet it would only be right for there to be a
carveout in Bill 122 for projects that have already received Planning Approval to be grandfathered
and allowed to complete their project and receive their Certificates of Occupancy even if the Bill
passes.
I appreciate you considering my testimony when choosing how to vote on these Bills.
