V OF of <br />COUNTY OF HAWAIJ STATE OF HAWAIJ <br />BILL NO. 206 <br />ORDINANCE NO. <br />AN ORDINANCE REPEALING ORDINANCE NO. 84-39 AND AMENDING CHAPTER <br />14, ARTICLE 8, SECTION 14-44, OF THE HAWAIJ COUNTY CODE 1983 (2016 <br />EDITION, AS AMENDED), RELATING TO NUCLEAR ENERGY. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAVI: <br />SECTION 1. Findings and Purpose. The County of Hawaii recognizes the critical <br />importance of safeguarding the health, safety, and welfare of its residents and environment. With <br />growing concerns about the potential hazards posed by the transportation, storage, and <br />development of nuclear materials, it is essential to ensure that all entities within the County, <br />including military operations, are subject to appropriate regulatory measures. This ordinance <br />seeks to remove the exclusion that previously applied to military activities in this regard, <br />aligning with the County's broader commitment to minimizing radiation risks and maintaining a <br />safe and clean environment for both present and future generations. This ordinance reflects the <br />County's dedication to comprehensive public safety without compromising national security <br />responsibilities. <br />SECTION 2. Ordinance No. 84-39 is repealed. <br />SECTION 3. Chapter 14, article 8, section 14-44 of the Hawaii County Code 1983 <br />(2016 edition, as amended) is amended to read as follows: <br />"Section 14-44. Purpose. <br />The purpose of this article is to maintain a clean and healthy environment for <br />present and future generations in the County, to protect the health and safety of the <br />residents of the County from radiation exposure resulting from dangers of accidents <br />involving the transportation or storage of nuclear materials or the development of nuclear <br />reactors, and to protect the general health, safety, comfort and welfare of the citizens of <br />the County. <br />eaffying out theif duties and fespensibilities.]" <br />SECTION 4. Severability. If any provision of this ordinance, or the application thereof <br />to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br />applications of the ordinance that can be given effect without the invalid provision or <br />application, and to this end the provisions of this ordinance are severable. <br />
