Kierkiewicz, Council Member /Z DATE: October 2, 2024 SUBJECT: Proposed Amendment to Bill No. 121, Draft 4; an Ordinance Amending Chapter 25, Articles 1, 4, and 5, of the Hawaii County Code 1983 (2016 Edition, as Amended), Relating to Transient Accommodation Rentals and Hosting Platforms. Transmitted herewith is a proposed amendment to Bill No. 121, Draft 4. The proposed amendment is shown below in Ramseyer format with respect to the contents of Bill No. 121, Draft 4; material to be deleted is bracketed and stricken, and material to be inserted is underscored. A copy of the new draft of this bill that would result if this pro -posed amendment were adopted is not attached. SECTION 6 of Bill No. 121, Draft 4, which amends chapter 25, article 4, of the Hawaii County Code 1983 (2016 Edition, as amended), is amended by amending section 25-4-17.1 to read as follows: "Section 25-4-17.1. Date OCT - 2- 2024- (a) The council or director may establish a visitor destination area by ordinance, pursuant to section 25-2-43, if the following criteria are met: There is a high concentration of transient accommodation rentals in the area, The area has the capacity to handle increased visitor activity with adequate infrastructure; and There is insufficient availability of resorts or hotels in the area to meet tourism demand. Property owners within the proposed visitor destination area, along with neighboring properties within a three -hundred -foot radius, shall be notified by mail and invited to a community outreach meeting convened by the initiator of the bill to gather input before the bill to establish a visitor destination area is introduced."
