SUBJECT: Proposed Amendment to Bill No. 134, Draft=2: AN ORDINANCE AMENDING
CHAPTER 25, ARTICLE 2, SECTION 25-2-42 OF THE HAWAII COUNTY
CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO
AMENDMENTS INITIATED BY PROPERTY OWNERS AND OTHER
PERSONS.
Transmitted herewith is a proposed amendment to Bill No. 134, Draft 2. The proposed
amendment is shown below in Rarnseyer format with respect to the contents of Bill No. 134,
Draft 2; material to be deleted is bracketed and stricken; material to be inserted is underscored,
SECTION 1 of Bill No. 134, Draft 2, which amends chapter 25, article 2, section 25-2-42 of the
Hawaii County Code 1983 (2016 Edition, as amended) by amending subsection(c), is amended
by amending paragraph (4) to read as follows:
"(4) The director shall prepare a report identifying all buildings, exeluding o sti .
buildings, that are legally pen*;itte- e enst uete ] on surrounding properties of
which any portion is within [one ,,uat!ter-mile e one thousand feet, in the case of a
subject property in the State land use a ricultural district or three hundred feet in
the case of a subject pmperty in either the State land use urban or rural districts of
the perimeter boundary of the subject property[. The direeter], and further shall
transmit the report to the commission and the council prior to their respective
consideration of the change of zone sought by the application, The report shall_
include:
(A) All changes of zone, and amendments thereto, granted to surrounding
properties,
B A descri tion of the status of each condition for aLly such change of zone that
is not.yet completed and subject to a time limitation; and the remaining._time
_provided for the performance thereof; and

A copy of the new draft of this bill that would result if this proposed amendment were adopted is
intentionally omitted due to the limited scope of the amendment.
