Your Policy Committee on Planning, Land Use, and Development, to which was referred Bill
No. 217, reports as follows:
Bill No. 217, transmitted by Council Member Cindy Evans via Communication No. 1093, dated
September 24, 2024, amends Chapter 6, Article 2, Section 6-12, of the Hawaiʻi County Code
1983 (2016 Edition, as amended), relating to prohibited highways for commercial bicycle tours.
The bill seeks to add a portion of Kohala Mountain Road and a portion of Akoni Pule Highway
as prohibited highways for commercial bicycle tours.
As Bill 217 was introduced, Committee Vice Chair Holeka Inaba assumed the role of Acting
Chair, with Committee Chair Ashley Kierkiewicz absent.
Public Works Director Steven Pause and Corporation Counsel Elizabeth Strance were available
in the Kona Chambers for questions.
Ms. Evans explained the bill would prohibit commercial bicycle tours on two roads in Kohala
due to community safety concerns.
County Clerk Jon Henricks noted the review process pursuant to Chapter 6, Article 2, Section 6-
11(b), about soliciting feedback from State and County agencies.
Committee Members Matt Kānealiʻi-Kleinfelder, Susan Lee Loy, and Heather Kimball agreed to
proceed with the review process. Ms. Kimball suggested holding the measure in Committee until
hearing from governmental agencies. Ms. Lee Loy and Committee Member Jennifer Kagiwada
recommended sending the measure to the Hawai‘i Department of Transportation (HDOT).
Mr. Pause confirmed Kohala Mountain Road is state-controlled, while Akoni Pule Highway is
under County jurisdiction. Ms. Strance shared she would need to verify if a County ordinance
can regulate a state highway.
Ms. Evans motioned to forward the bill to the Police Chief, Public Works Director, and Director
of HDOT. The committee passed the motion with eight “ayes”, and Chair Kierkiewicz absent.

Your Policy Committee on Planning, Land Use, and Development is in accord with the purpose
and intent of Bill No. 217, and recommends its passage on first reading.
