Re: Protect Puako /Bridge Puako Timeshare Project
Dear Mr. Tyler:
I am enclosing a copy of a letter dated February 29, 2000 from the attorney for
Bridge Puako in which Bridge Puako declines to provide a copy of its time share
study to Protect Puako. Protect Puako's oral requests for a copy of the traffic
analysis and impact study was also refused.
The Planning Commission had neither study available to it at the time it voic'd its
support for the proposed timeshare resolution. Similarly, the Planning
Department staff had neither study at the time it recommended the Planning
Commission voice its support.
On behalf of Protect Puako, I request that the Planning Committee defer
any action until interested parties like Protect Puako have had a fair and
reasonable opportunity to review and comment on the reports which
supposedly serve as the basis for the proposed resolution. If it acts otherwise,
the Planning Committee would not properly be representing its constituents and
would risk reversal of adoption of the proposed resolution as an arbitrary act.

Dear Mr. Strauss:
This is in response to your attached letters of February 18 and 22, 2000
respectively requesting: 1) permission for Protect Puako to enter onto the Bridge Puako LLC
property to conduct a botanical survey by a botanist engaged by Protect Puako, and 2) to provide
you with a copy of a KPMG Peat Marwick study on behalf of Bridge Puako, LLC.
Since Protect Puako and your clients Messrs. Mader and Mitchell have not yet
been granted status as parties in any contested case proceeding before the Planning Commission,
we will defer making a decision on the above two requests pending final action by the Planning
Commission on the issue of standing. Assuming that your clients are granted standing to
participate in any contested case proceeding before the Plamiing Commission on these matters,
you may resubmit your request.
