Re: Bill 181 - General Plan Amendment Procedure
Dear Chair Kimball and Council Members:
This letter follows up on a request for clarification of this department's legal opinion
contained in Communication 939.7 regarding Council's current authority to make
substantive amendments to a general plan bill when submitted to Council for
review.
The Council has authority to make substantive amendments to a general plan bill
so long as it submits Pro -posed substantive amendments to the Windward and
Leeward Planning Commissions as required by Sections 6-7.5(a)(2) and 6-7.5(a)(c) of
the Hawaii County Charter, and follows the procedure for Council initiated interim
amendments contained in Section 16.2 of the 2005 General Plan, as amended.
