A RESOLUTION AWARDING A PUBLIC ACCESS, OPEN SPACE, AND NATURAL
RESOURCES PRESERVATION MAINTENANCE FUND STEWARDSHIP GRANT TO

WHEREAS, Section 10-15 of the Charter of the County of Hawaii (Hereinafter
"Charter") provides for a Public Access, Open Space, and Natural Resources Preservation Fund
(hereinafter "Preservation Fund") to acquire lands and easements within the County for public
outdoor recreation, education, the preservation of land and coastal areas, and the protection of
natural resources; and
WHEREAS, Section 10- 16 of the Charter establishes a Public Access, Open Space, and
Natural Resources Preservation Maintenance Fund (hereinafter "Maintenance Find") to be used
in part for a stewardship grant program, in which 501(c)(3) nonprofit organizations can apply for
and receive grant-in-aid finding for stewardship projects directly related to public safety
maintenance and preservation of lands and easements acquired using the Preservation Fund; and
WHEREAS, Hawai`iTarmers Union Foundation is a 501(c)(3) nonprofit organization
whose mission is to support Hawaii farmers in creating and sustaining vibrant and prosperous
agricultural communities for the benefit of all Hawaii through various scientific, educational,
and charitable activities; and
WHEREAS, Hawaii Farmers Union Foundation applied for a Maintenance Fund
stewardship grant to maintain a healthy stewardship of the land identified by Tax Map Key No.
(3) 5-5-015:042, also known as Banyan Trees Park, which is situated in the district of North
Kohala and was acquired using the Preservation Fund as authorized by Resolution No. 332-14;
and
WHEREAS, pursuant to Section 2-217 of the Hawaii County Code 1983 (2016 Edition,
as amended), the Public Access, Open Space, and Natural Resources Preservation Commission,
during its meeting on September 11, 2023, recommended that this stewardship grant be awarded;
and
WHEREAS, funds awarded by this stewardship grant will be used to support ongoing
maintenance efforts on the property and to develop a management plan that reflects and
incorporates community input and engagement; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, in
accordance with Section 10-16(h) of the Charter, a stewardship grant is hereby awarded to
Hawaii Farmers Union Foundation in the amount of $56,900 out of and from the Public Access,
Open Space, and Natural Resources Preservation Maintenance Fund and for the purposes
hereinabove described.
BE IT FURTHER RESOLVED that the Director of Finance is hereby authorized and
directed to make necessary payments or expenditures in accordance with the terms of this
resolution.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Director of Finance.
