Subject: Bill 121 -
To the Esteemed Members of the Hawaii County Council,
I am writing with deep concern regarding the proposed expiration of Nonconforming Use Certificates
(NUCs) upon the sale of property as outlined in Bill 121.This amendment threatens to significantly
devalue my property and disrupt my financial planning.
When I purchased my property, the NUC was a crucial factor in its valuation and my decision to invest.
Knowing that I could transfer this permit to a future buyer provided security and contributed to the
property's worth.
The proposed change feels like a retroactive alteration of the agreement under which I purchased the
property. It could force me to sell at a reduced price or hold onto the property longer than planned, both
of which could have severe financial repercussions.
I respectfully request that you reconsider this provision to protect the investments and property rights of
residents who have acted in good faith under the existing regulations.
