Re: Opposition to Bill 121
Aloha, Chair Kierkiewicz,Vice Chair Inaba and all County Council Members:
Today I am testifying as a private citizen regarding Bill 121. Please note that I am not citing a draft
number. This is because we have all lost track of which draft is on the table and which
amendments are being proposed. The Agenda for today's meeting states that there is a
recommendation to pass Draft 3, but we currently have Draft 4 plus Communication 0675.591
amending Draft 4, plus a new draft of Bill 122 re B&B,while at the same time you are proposing to
include B&B in Bill 121. Then throw in the radical Communication 675.509 from the Oct 2 meeting,
of which many of the proposed terms are illegal, and it is amazing that any of your constituents are
able to determine what is currently on the table. Perhaps this is intentional on the part of the
Council.
I will not take the time to refute the radical terms of that Oct 2 communication. That version of the
bill is a bridge way too far and violates individual property rights and contains unconstitutional
terms. Council members, please be aware that if you attempt to pass a similar version of this bill
that you will be opening up yourselves and the County to lawsuits.
What started out as a"simple registration"has now become extremely complicated and mired
down in minutiae. Enough already! It's been 2 years! "Time is Money,"and the time of the Council
Members,your staff,the County Clerk's office and all your constituents'is a waste of resources that
could be utilized for things that are desperately needed—attainable housing,our wastewater
systems,streamlining the permit system and incentivizing development. Please take this proposed
legislation back to the original intent and stop adding this,that and the other non-essential
requirements. And I will reiterate that this bill should be tabled until the results of the Economic
Impact Study are released early next year.
