Aloha County Council Members, apxY,
I am submitting testimony against Bill 121 and specifically against the recent amendments irihe
enormous and highly confusing COM 0675.592 which modifies the already complicated Bill 121 Draft 4
to create even more problems and issues.
' This bill has become a quagmire full of contradictions and it doesn't make sense for Hawaii Island's
economy. I have been following this bill for over a year reading each draft and at this point even I can
barely follow along. It is a total mess. This amendment appears to be almost an entire new draft with
huge changes but yet no updated draft was provided with the amendment. Is that allowed?
The removal of operator hosted rentals now after a year of talking about it is confusing&appears to put
an entire class of current STVRs into limbo.
The new proposals also appear to attempt to indirectly eliminate TAR in ag zoned areas by what appears
to be saying that they would need to be BNBs with special use permits issued by the Council? I think? I
honestly can't even tell because the huge amendment did not include a new bill draft.
The communication and outreach on these more recent changes later in 2024 has been abysmal- it
seems to be the bare minimum to attempt to stay compliant with the sunshine law and even that is
questionable.
Finally, ag land makes up all but 5%of the living areas in Hawaii Island including all the small towns
outside of Kona and Hilo.This bill will kill the small town's economies no matter how many times it is
rewritten.Almost every restaurant, shop and other main street business will close in these small towns
without visitors staying in them. It is already happening with the huge drop off in tourism that has already
begun.
Please stop, do a current Hawaii County specific economic impact study that focuses only on STVRs
before trying to pass a bill that regulates them.
