My testimony is in opposition to the current draft of Bill 121.
When this bill was first created 4 years ago, I questioned Ms. Kimball about the intention
of the Bill and what she hoped to accomplish.
Her answer was to "create more housing". I hope this will make council members think
more about the intention of the bill. We have since then been able to see more
affordable housing being created to fill the void. I really don't think that intention was
the aim for the bill.
When the bill or ordinances were first introduced, we were burdened with 16 pages of
confusion and contradicting verbiage that changed so so many times in the past 4
years. Now we have a 30 page bill before us that limits our constitutional rights of
ownership. How can ANYONE tell us what we can own and what we can't? A
person should be able to own multiple units.
If the ownership is limited to a "natural person", we have a real problem! There is a
tremendous amount of properties that are held in trust and according to this change,
that wouldn't qualify for ownership. And the 50% is not allowing property to be passed
on depending on the tenancy of ownership. There are families involved with ownership
that could be 1/8th ownership, that disqualifies them. Both these limitations should be
omitted.
There are elderly people I know that rent out 2 or more rooms in their house to
students. The limiting of one TAR per site again is unconstitutional and will harm the
small person trying to make ends meet.
Finally, if a person has worked for years to create a profitable TAR and the bill here says
that if obtained with a NUC and they want to sell the property; that property is no
longer marketable as a TAR. Would you take away that value just because you want it
to cease existence?
I urge you to please stop this unending taking of our rights, stop and think about why
this bill was created, and why do we really need it?
