Dear Council Member Villegas, Ltd - -
I currently own a lovely home in Kona that we are fortunate to visit frequently throughout the year
and have concerns regarding the proposed amendments to bill 121.
1. For what purpose are you proposing NUC no longer transfer with the sale of my
property. Are you angry at Americans that want to own a second home on the island and
choose to offset their expenses with rental income?
2. If my neighbor doesn't like me, can they fraudulently file a noise complaint so that I
lose my NUC permit? Where is my protection against an angry neighbor.
3. What are the "new standards" you are proposing and how will they be enforced?
Our personal situation is that, while we are not on the island, we rent out our home to other visitors
to the island to offset our expenses. We have been fortunate enough to employee many local
providers to help manage our property, from landscaping to cleaning. These local providers are
critical to the upkeep of our property, and we appreciate the care and pride they have for their island
and our property. Should these amendments to the bill pass, these wonderful, mostly small
businesspeople, will be slowly and permanently phased out. They will be forced to work for the
large, impersonal resorts or change professions altogether. I hope you understand, that it's not only
the devaluation of my particular property that would be affected, but the lives of the Kona small
business owners that help us to maintain our lovely home.
I truly understand the need for affordable housing for your community and sympathize with their
struggles to provide homes for their families. Unfortunately, I feel that with the confusion
surrounding these amendments and the how it will negatively impact the residence, it is not the best
options. There are many other alternatives to this issue, options that do not include the devaluation
of our property and the loss of small business owners on the island.
Sometimes I wonder why these amendments are even being considered given the impact to your
constituents. Who would benefit most from the decline of NUC certificates for homes on the
island. The only answer I can glean is the large, very well-funded, resorts. Is this really the
impression you want to put in your community do you really want people to think you are on the
side of the big corporations?
I don't think you do and I truly believe the council can come up with other options for your island
that solve the affordably housing issue for your constituents, families and Kona residents. S. --
