To the Honorabte Members of the Hawaii County Councit,
I am writing to express my profound concern regarding the proposed amendment in Bitt 121 that
mandates the expiration of Nonconforming Use Certificates (NUCs) upon the sale of a property. As a
smatt business owner who has invested in vacation rentat properties through a family -owned LLC, this
change threatens not only our livetihood but atso the financiat future of our family.
When we purchased our property, the NUC was an integral part of its value. It was not merely a permit
but a critical asset that justified the significant investment. The proposed expiration of NUCs upon sale
effectively strips away this value, constituting a de facto taking of property without just compensation.
This undermines the fundamental principles of property rights and coutd be considered unconstitutional.
Furthermore, owning property through a business entity like an LLC is a common and tegitimate practice
for asset protection and estate planning. Penatizing business ownership structures by invalidating NUC|o
upon transfer disrupts estabLished financial ptanning and couLd have far-reaching negative impacts on
the real estate market. I respectfuRy urge the council to reconsider this amendment to protect the rights
ofproperty owners and maintain confidence inour iOC8ieconomy.
