CALL TO The regular meeting of the Committee on Legislative Approvals and Acquisitions
ORDER: was called to order at 1:00 p.m., in the Council Chambers, Kailua-Kona, by

FROM THE AGRICULTURAL DISTRICT TO THE RURAL DISTRICT AT
WAIMEA, SOUTH KOHALA, HAWAI`I, COVERED BY TAX MAP

(Note: There is a motion by Ms. Kierkiewicz, seconded by Ms. Lee Loy, to
recommend passage of Bill 198 on first reading.)
CHR. INABA: Thank you, Mr. Clerk. We do have the applicant's representative,
Daryn Arai, joining us on Zoom. It was requested by the applicant that we
postponed this matter to the January nth Committee meetings. So, if there is no
discussion, I would ask for that motion to be made. Council Member Villegas.
MS. VILLEGAS: Thank you. I just want to take a moment to thank the testifiers
for being here today. I've had the pleasure and the honor of working with you.
You're small business owners in Waimea and you provide impeccable service and
have a reputation and relationships with your community as authentic community
members. Not a nimby but somebody who is invested in your community, and I
just want you to know that I take your words, and your pleads, and your
questioning; the truth and integrity of statements that have been made by the
potential developer. And I just want you to know personally and professionally
that I honor that.
I honor the personal message of the testimony of a cry -out for acknowledgement
of capacity and for what we're setting a precedent if decisions get made to make
changes to Land Use Zoning, that set off a negative trickle affect. And that
provides opportunity for select few to become very wealthy; and for those left
living with the repercussions of that to suffer, because we don't have the
infrastructure necessary to support these rural communities which are directly
impacted by everything that comes through there.
So, I just wanted to make that statement. I'll be supporting the postponement.
just wanted you to hear that, and thank you for continuing to show up. We
appreciate you. I yield.

MS. EVANS: Yes, thank you. Just being the representative from the district, I
just wanted to comment to everybody involved to stay engaged, stay tuned. And
more importantly, for me, it is I think what was pointed out by testifiers, and there
was a lot of written testimony on this, is that you know, changing this Ag to
Rural. If you look at the land use patterns now, we don't have Rural out in this
area at all. We do have Agriculture. We do have some Urban. But the reality is,
this is I think, a significant shift, and that is why we're having everybody coming
out and speaking. And I'm going to encourage everybody, even though it's
postponed till after the holidays, that we have to be vigilant, and we just have to
watch and keep this discussion going.
To the Metzler's that are trying to develop their property, I strongly encourage
you to please keep engaging with your neighbors and your neighborhood to see,
you know, what their concerns are.
Then lastly, I do want to say, I do have concerns about the floodplain. And I'm
hoping that we hear more about how that is going to play out with or without the
development. Thank you, I yield.

ARTICLE 8, CHAPTER 25 (ZONING CODE) OF THE HAWAI`I COUNTY
CODE 1983 (2016 EDITION, AS AMENDED), BY CHANGING THE
DISTRICT CLASSIFICATION FROM AGRICULTURAL — 5 ACRES (A-5a)
TO RESIDENTIAL AGRICULTURAL — 0.5 ACRES (RA-0.5a) AND
NEIGHBORHOOD COMMERCIAL—10,000 SQUARE FEET (CN-10) AT
WAIMEA, SOUTH KOHALA, HAWAI`I, COVERED BY TAX MAP

(Anblicant: Kaubulehu Land, LLC) (Area: 5.349 Acres)
The Leeward Planning Commission forwards its favorable recommendation for
this amendment to the State Land Use Boundaries Map and an unfavorable
recommendation for the requested change of zone, which would allow applicant
to subdivide the property into eight lots consisting of three retail/commercial lots
fronting Mamalahoa Highway and five residential agricultural lots. This property
is located at 64-983 Mamalahoa Highway.
