Enclosed is a bill for an ordinance to add an appropriation to Ordinance 24-33, the
Capital Budget, for the Department of Public Works' "Waiakea Stream Mitigation"
project and to appropriate $1,000,000 to the Capital Budget for this project.
The Department of Public Works requests that this bill be waived by the Finance
Committee and be placed on the December 18, 2024 Council agenda in order to expedite

The Department of Public Works is requesting an ordinance amending Ordinance 24-32, as amended, by
adding appropriation to the Operating Budget to appropriate Highway Fund Balance from previouse year to
the following Highway Fund account:
Revenue 020,3609.10 - Highway Fund Balance from Previous Year $1,000,000
Expenditure 020.801.5801,34.341 - Transfer to Capital Projects Fund $1,000,000
The Department of Public Works is also requesting an ordinance amending Ordinance 24-33, as amended
by addition appropriation to the Capital Budget for the following project:
Waiakea Stream Mitigation-110,299.5295,13.115 $1,000,000
To expedite the availability of funds, we are requesting to waive the Finance Committee meeting and be
placed on the first available Council Meeting in 2025.
B. BACKGROUND AND JUSTIFICATION USE ADDITIONAL SHEETS AS NEEDED ;
In April 2024, a contractor working for DPW Highways performed work in the Waiakea Stream channel.
Their work scope was to include cutting and removal of vegetation on the channel bed within the drainage
easement belonging to the County. Unfortunately, the contractor expanded their work outside of the
County's easement, onto private property, and caused damage within the stream, on adjacent
embankments, and on private property.
The County is responsible for repairing damage to the Waiakea Stream between W. Kawailani Street and
Kupulau Road (approximately 2,800 feet), The primary concern is the work conducted on private property,
covering about 1,300 feet, This unauthorized work involved grading (excavation and fill) the stream bed and
embankment.
An urgent issue is the removal of a section of embankment (up to 15 feet) on an adjacent property, which
now leaves the yard and nearby house vulnerable to water erosion. The County is collaborating with the
USACE and DLNR to determine the necessary steps for mitigating, restoring, and repairing the Waiakea
Stream. The County is also looking into acquiring the affected properties to facilitate repairs and future
maintenance.

AS AMENDED, RELATING TO PUBLIC IMPROVEMENTS AND FINANCING THEREOF FOR
THE FISCAL YEAR JULY 1, 2024 TO JUNE 30, 2025.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above -referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
