N Parsons: It's the tax payment on unrelated business income from the 2023 HSAC Conference that needs to be paid before October 20th. a. September 20, 2024 Executive committee meeting. No Amendments 4. REPORTS a. Treasurer's Report As of September 30th, 2024: • The balance in the primary HSAC account: $82,871.52 • The balance in the HSAC conference account: $326,764.60 * Total deposit account balances: $409,63612 CM Waters: Airbnb sent their sponsorship check and their golf of $5,800 to the main account. So it didn't go to the conference account. Motion to accept report for audit. Approved b. County Reports: i. County of Hawaii CM Kimball: County of Hawaii will just stand on a written report. With the exception, I did want to highlight that we conducted our 1st ever limited meeting under chapter 92, we did a site visit to a property that we're considering a rezoning ordinance on. It was helpful to see the site in person. ii. County of Kaua'i CM Carvalho: We submit our written report as well. if you have any questions let me know. iii. I just want to add that the lack of archeologists at Ship D is causing a real problem for us with the historic district and the rebuild. We have about 60 cultural monitors phasing out from the debris removal. I heard that there's an online certification course from Washington State University with a certificate to become archaeological monitors, which we're desperately in need of also. They can walk out with like 50 to $70,000 annual a year jobs. So we're trying to see if maybe half of the cultural monitors can convert and become archaeological monitors. iv. City and County of Honolulu CM Waters: I just want to report on Bill 46, which is the empty homes tax moving through our council. It's been difficult. What I'm trying to do is figure out as many exemptions as possible so that we don't affect local people. CM Kimball: Have you looked at our 2 tier system for residential as another possible alternative? We have homeowners, which are the lower tax rate, and they get all the homeowner benefits. But then we have the residential rate, and it's tiered, and I think Maui does this, too. Where once you get over 2 million, anything over 2 million gets taxed at a higher rate, and that brings that revenue. CM Paltin: We have 3 tiers of non owner occupied. It's been a great tool to not ring out the lowest properties, while we get a little bit more revenue from the higher end properties. The important thing to distinguish is it's progressive. So everyone, their 1 million dollars of value is treated the same. Motion to accept county reports. Approved. c. NACo Report CM Waters: Dec 3-7th. Hotel is sold out, but we could rent a house for cheaper if anyone else is going. Conversation on who is going and for Tamara Paltin to go, discussion on fire mitigation from Sonoma fires. d. WIR Report Shane Sinenci: Researching what hotels will be available in Kaanapali. Michelle Galimba: happy to help with finding speakers. e. Executive Director Report N Parsons: Putting together the guidebook for review of the conference. Thank you Tommy for hosting and all the time and effort and money raised. Legislative Report N Parsons: If you're in person on Oahu for whatever reason, this applies to the HSAC executive committee, I can reach out from now until December to do some legislative meetings. Maybe you can let me know an afternoon that you have open and I can see if we can get a couple of meetings scheduled to touch bases with some legislators. Motion to accept reports. Approved. 5. UNFINISHED BUSINESS a. Review and approval of the following documents from Carbonaro CPAs & Management Group: i. Conflict of interest policy. ii. Whistleblower policy. iii. Document retention and destruction policy. We're gonna have an extension on the actual filing. So we can wait for the documents. But we have to make the payment. 6. NEW BUSINESS a. Discussion and review of A RESOLUTION RECOGNIZING UTAH v UNITED STATES LEGAL ACTION AS SET FORTH IN UNITED STATES SUPREME COURT DOCKET NO. 220160, presented by Council member Sue Lee Loy, NACo Board member, from Hawaii County Council. Michelle Galimba: I just worry that they're not going to be as environmentally conscious as I believe they should be. Ranchers do have a very strong interest in grazing and sometimes those uses can conflict with some of the ecological and environmental best practices. Sue Lee Loy: My opinion is to show support to them. Esther Kia'aina: I don't think we should also be looking at the bigger picture of our Federal delegation and the relationship with these States. b. Maui County Resolution No. 24-158, APPROVING THE HAWAI`I STATE ASSOCIATION OF COUNTIES EXECUTIVE COMMITTEE'S October 17, 2024, HSAC Executive Committee Meeting Minutes Page 15 SAS ORCOUNSty WESTERN INTERSTATE REGION BOARD OF DIRECTORS FOR THE 2024-2025 TERM, which was approved by the Maui County Council on September 13, 2024. Hawai'i County Resolution No. 629-24 A RESOLUTION APPROVING THE NOMINATION OF MEMBERS TO THE NATIONAL ASSOCIATION OF COUNTIES BOARD OF DIRECTORS AND THE WESTERN INTERSTATE REGION BOARD OF DIRECTORS, which was approved by the Hawaii County Council on September 17, 2024. City and County of Honolulu Resolution No. 24-241, APPROVING THE HAWAI'l STATE ASSOCIATION OF COUNTIES' NOMINEES TO THE NATIONAL ASSOCIATION OF COUNTIES AND THE WESTERN INTERSTATE REGION BOARDS OF DIRECTORS FOR THE 2024-2025 TERM, which was approved by the Council of the City and County of Honolulu on October 9, 2024. Maui County Resolution No. 24-127, APPROVING FOR INCLUSION IN THE 2025 HAWAII STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE A STATE BILL ON STATEWIDE COMPOSTING, which was approved by the Maui County Council on September 13, 2024. October 17, 2024, HSAC Executive Committee Meeting Minutes Page 1 6 3�5<"tEAS =f i z O'tCOUNS�ty CMPaltin: What we want to try and do is like, make the Department of Health see that composting is a valuable tool in the fight against the spread of invasive species, and that it should be supported to the extent that it doesn't cause any health problems. - The bill is basically asking them to create this for composting and co -composting operations, to create a classification system. CMKimball: I would be more supportive of including this in our waste like priorities. But maybe not necessarily this bill. Measure not approved for inclusion in the HSAC legislative package. f. Maui County Resolution No. 24-130, CDI, RESOLUTION APPROVING FOR INCLUSION IN THE 2025 HAWAI`I STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE A STATE BILL RELATING TO THE COMMISSION ON WATER RESOURCE MANAGEMENT, which was approved by the Maui County Council on September 13, 2024. Measure not approved for inclusion in the HSAC legislative package. g. Maui County Resolution No. 24-134, APPROVING FOR INCLUSION IN THE 2025 HAWAII STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE A STATE BILL RELATING TO A DEFERRED RETIREMENT OPTION PROGRAM FOR POLICE, which was approved by the Maui County Council on September 13, 2024. Measure approved for inclusion in the HSAC legislative package. h. Hawai`i County Resolution No. 630-24 (Draft 3) , A RESOLUTION APPROVING THE HAWAI`I COUNTY COUNCIL LEGISLATIVE PROPOSALS AND PRIORITIES TO BE CONSIDERED FOR INCLUSION IN THE 2025 HAWAI`I STATE ASSOCIATION OF COUNTIES LEGISLATIVE PACKAGE, which was approved by the Hawaii County Council on October 2, 2024. October 17, 2024, HSAC Executive Committee Meeting Minutes Page 1 7 a�ssa*E�a� OpC UNS�ES Proposals: 1) CM Kimball: The 1st one is the repeal of the preemption with respect to the tobacco products we did this last year, and ended up actually joining on another bill rather than our own bill. Measure approved for inclusion in the HSAC legislative package. 2) CM Kimball: The second one is a State land use boundary amendment for contiguous smaller parcels. We are particularly interested in it in Hawaii County, because there are a lot of parcels that are state land use. Ag, that really would be better off as rural and having them as rural, would allow them to build accessory dwelling units for kids and parents and things like that. CM Paltin: What we're seeing in our rural areas is these gentlemen, farmers, luxury estates trying to prevent real agriculture from happening. So on Maui we're not super supportive of turning ag land into rural and the increased density, because we don't have the infrastructure or the land for that kind of thing in rural areas. Measure NOT approved for inclusion in the HSAC legislative package. 3) CM Kimball: Okay, so the next one is denitrification required for wastewater systems. This would be for areas that do not have sewer, and they are going to do individual wastewater systems. If they're doing a septic they would be required in certain areas to also include denitrification, which is the main nutrient that is damaging to our reefs. Measure approved for inclusion in the HSAC legislative package. 4) Jenn Kagiwada: This next one is really about allowing the birth practitioners to practice legally while they're continuing to investigate ways for more licensure. But it's really also, primarily a lot about rural communities that don't have access to the health care they need very easily. Measure NOT approved for inclusion in the HSAC legislative package. S) CM Kimball. -It's advancing the timeline for cesspool conversion for the priority one areas, and then also creating a funding mechanism and additional positions with respect to that in the DOH. Measure approved for inclusion in the HSAC legislative package. 6)CM Kimball: The next item is the introduction of the extension of the GET surcharge. We find this surcharge super invaluable with respect to our mass transit and want to keep it going. CM Paltin: Maui was the last to adopt it, and they restricted us on what it can be used for. I think it was just sewer and water infrastructure. If we re -up, it would be nice if it were open to be used equally across all the counties, for all the things. Measure approved for inclusion in the HSAC legislative package. 7)The next item is relating to agricultural tourism. We in Hawaii County would like the opportunity to regulate TARS under ag tourism. It would allow us to ensure that agricultural activities were happening when there was a TAR on ag land. Measure NOT approved for inclusion in the HSAC legislative package. 8)Jenn Kagiwada: The homeless services fund through conveyance tax. It's a conveyance tax that the State would do, but it would allow some special funds to go towards affordable homeownership, revolving fund, homeless services, special fund dwelling unit revolving fund and amend allocations to the Land Conservation Fund and Rental Housing Revolving Fund. Sue Lee Loy: Connections funding are innovative solutions, to me that is a very forward thinking type of piece of legislation. It has to get more broad and inclusive to start addressing the other barriers that are getting in the way of housing (wastewater issues, cultural reviews, ect). Measure approved for inclusion in the HSAC legislative package. 9) This bill proposes the same preferences for local workers, local residents, returning students from college and even county and state workers for 201Hprojects. Measure approved for inclusion in the HSAC legislative package. So that leaves for inclusion in our package: the retirement, the drop bill, tobacco, denitrification, cesspool timeline, GET, conveyance tax and housing preference. Priorities: 1) Increasing funds for emergency preparedness community level emergency planning. Approved. 2) Legislation related to lowering costs and homeowners and businesses. Approved evacuation routes, notification systems, expanding availability of insurance for 3) Legislation related to workforce development, particularly for green jobs and government positions. Approved. 4) The midwifery, licensure and reproductive health care is there as a priority. NOT Approved. 5) There's the priority gain management for wild ungulates, pigs, deer, all the things. Approved. 6) Legislation related to extended producer responsibility for solid waste. Approved. 8) Food security relating to access to locally produced food. Approved. 9) Improving public safety and access to mental health resources, community courts, and comprehensive support services. Approved. 10) Preventing squatters and supporting property owners impacted by squatting. Approved. Voting - It looks like we only have the midwifery one as not being accepted by all of the members for priorities. Nahelani Parsons: We have to vote on the amended agenda item for the taxes. So the amount to be approved for payment is 3,895.92 for Federal and 860.29 for for State, and we're going to pay that on October 20th CM Waters: I move we pay this bill from Auditing/Professional Services Motion to receive.
