HomeMy WebLinkAboutBIL 012 Draft 01 2024-2026 AN ORDINANCE AMENDING CHAPTER 5D, ARTICLE 1, SECTIONS 5D-1-3 AND 5D-1-6, OF THE HAWAI‘I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO THE ELECTRICAL CODE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I: SECTION 1. Chapter 5D, article 1, section 5D-1-3, of the Hawai‘i County Code 1983 (2016 Edition, as amended), is amended to read as follows: “Section 5D-1-3. Scope; exceptions. This chapter shall apply to electrical work and installations within the County inland of the shoreline high-water line[. This chapter shall not apply to work], except: (1) Work or installations not covered by the National Electrical Code, 2017 Edition, as adopted [by chapter 5D, this electrical code.] in section 5D-2-1; and (2) Electrical work by an electrical utility on any generating plant, receiving station, switching station, distributing station, supply lines or mains, overhead service drop, and underground or station service supply conductor under the control of the utility.” SECTION 2. Chapter 5D, article 1, section 5D-1-6, of the Hawai‘i County Code 1983 (2016 Edition, as amended), is amended by adding a definition to be appropriately inserted and to read as follows: ““Electrical utility” means a: (1) Public utility that produces, conveys, transmits, delivers, or furnishes electricity to the public; or (2) Person or entity who provides or intends to provide electricity for sale directly to a public utility, subject to regulation by the Public Utilities Commission. As used herein, “public utility” means the same as defined by section 269-1, Hawai‘i Revised Statutes.” SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material, and underscoring need not be included. SECTION 4. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 5. This ordinance shall take effect upon its approval.
