Re: Operating Budget
Enclosed is a bill for an ordinance appropriating $5,568. The University of
Hawaii at Manoa, Cancer Research Center of Hawai i, Prevention and Control
Program has provided funding to conduct a covert operation to decrease the
means for which juveniles obtain alcohol.
Also enclosed is a resolution authorizing the Mayor to enter into an agreement
with the University of Hawaii at Manoa.

A REQUEST:
To appropriate $5,568 under object code 115.
To enter into a contract with the University of Hawaii at Manoa, Cancer
Research Center of Hawaii, Prevention and Control Program to provide
funding under the Alcohol Prevention Grant.

SERVICES CONTRACT UNDER 525,000
This contrail is entered into by and between Hawaii County Police Department (Hilo)
whose mailing address is 349 Kaoiolani Avenue. Hilo HI 96720
hereafter known as Contractor, and The Research Corporation of the University of
Hawaii hereafter known as RCUH, on behalf of the Cancer Research Center of Hawaii.
University of Hawaii. Contractor hereby agrees to render such services and RCUH
hereby agrees to pay Conrailor, all upon the following terms and conditions:
1. SCOPE OF SERVICE. Contractor shall provide the following service(s):
The Community Policing Unit of the Hilo Police Department agrees to:
(11 conduct three (3) "stings" using minors as decoys to inspect
licensed retail liquor establishments in East Hawaii.
(2) use proieil funds for "buy money", food, incentives and roadblock
supplies.
The Community Policing Unit of the Hilo Police Department agrees to provide a
mid-term and a final report of the project to the Project PAU Council.
2. PERIOD OF PERFORMANCE. Services to be rendered by the Contractor
under this contract shall commence February 1, 2000 and shall be completed by
Mav 31.2000.
3. PAYMENT. For services rendered hereunder, Contractor shall be paid
Five Thousand Five Hundred and Sixty Eight Dollars ($5.568) which amount
shall include all applicable taxes. Total payment for services rendered under this
contract shall not exceed 5 568.
4. PAYMENT PROCEDURE. Unless othervvise stated, payment under this
contract shall be due and payable upon completion of services under this
contract and upon submission of original invoice in triplicate.
5. TERMINATION. The RCUH shall have the right to terminate this contract
upon 10 days written notice at any time and for any reason.
6. CONTRACTOR'S ETHICS DECLARATION. Contractor hereby declares:
a. That contrailor is not a legislator, elected or appointed official or
employee, or if a business, Contractor declares it is not owned or
controlled by a legislator, elected or appointed official, or employee.
b. That contrailor is not being assisted or represented in this matter by a
person who has been an employee within the preceding 2 years and who
participated while in office or employment in the matter with which this
contract is directly concerned.
7. INDEMNIFICATION. The Contractor shall defend, indemnify and save
harmless RCUH, its officers, employees and agents from and against all liability,
loss, damage, cost and expense including all attorneys' fees and all Gaims, suits
and demands therefor, arising out of or resulting from the ads or omissions of
the Contractor, including non compliance with federal, state county Taws, codes,
rules and regulations, while performing under, or in connection with, this contract.
8. PROPERTY RIGHTS. Any product or any kind resulting from work under his
contract shall be the sole property of the RCUH.
