Applicant: Keauhou Sunset Corporation (formerly LURI Corporation)
Subject: Annual Progress Report/Administrative Time Extension

This is to acknowledge receipt of your annual progress report dated March 6, 2000,
submitted in compliance with Condition P of the above-referenced ordinance. Thank you
for complying with the annual report requirement.
As requested, we will amend our files to reflect a change in entity from LURI
Corporation to Keauhou Sunset Corporation. The applicant has also requested an
extension of time until February 28, 2001 to Condition D relating to the payment of the
water commitment. We note that the Department of Water Supply has granted the
extension. We have determined that non-performance is a result of circumstances
beyond your control and not a result of fault or negligence, and hereby grant you an
extension until February 28, 2001 to comply with Condition D.
Please be aware that should you request an additional extension of time, your request
must be forwarded to the Planning Commission through this office. A $250 filing fee,
original and twenty copies of the request shall be submitted to this office. A public
hearing t<t consider vour request will be held within 120 days After such a hearing is
conducted, the request and the Commission's recommendation will be forwarded to the
County Council.

As a reminder, the applicant is required to comply with all conditions as stated in the
above-referenced ordinance within their appropriate timetables. The next annual report
will be due on or before September 19, 2000.
