COUNTY OF HAWAII <br />STATE OF HAWAI`I <br />RESOLUTION NO. 62 25 <br />RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO NEGOTIATE A <br />LEASE OF REAL PROPERTY, SITUATED AT KAILUA-KONA, COUNTY AND <br />STATE OF HAWAI`I, IDENTIFIED AS TAX MAP KEY (3) 7-5-008:027, TO THE <br />ASSOCIATION OF APARTMENT OWNERS OF KAILUA VILLAGE. <br />WHEREAS, the County of Hawaii owns the real property parcel identified as Tax Map <br />Key (3) 7-5-008:027 ("Parcel"), situated at Kailua-Kona, County and State of Hawaii, <br />delineated on Exhibit "A" attached hereto; and <br />WHEREAS, the Association of Apartment Owners of Kailua Village, a nonprofit <br />corporation, desires to lease the Parcel from the County, for visitor parking and fire lane access <br />purposes for the Kailua Village Condominium; and <br />WHEREAS, the Council of the County of Hawaii previously approved the lease of the <br />Parcel to the Association of Apartment Owners of Kailua Village for visitor parking and fire lane <br />access purposes; and <br />WHEREAS, the prior lease of the Parcel had a total collective term of fifty years, which <br />has now expired; and <br />WHEREAS, the Kailua Village Condominium wishes to continue to lease the Parcel <br />from the County for visitor parking and fire lane access purposes; and <br />WHEREAS, Section 2-120(a)(2) of the Hawaii County Code provides that the Council <br />of the County of Hawaii may, by resolution approved by a majority of its members, direct the <br />Finance Director to negotiate the lease of real property to nonprofit organizations, at such rentals <br />and on such terms and conditions as deemed proper; and <br />WHEREAS, Section 2-120(b) provides such lease of real property to nonprofit <br />organizations may be made without the notice or appraisal as required by Chapter 2, Article 19, <br />of the Hawaii County Code; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that <br />under Chapter 2, Article 19, Section 2-120(a)(2) of the Hawaii County Code, the Finance <br />Director is hereby authorized to negotiate a five (5) year lease of the Parcel (with one (1) <br />additional renewal option of five (5) years) with the Association of Owners of Kailua Village, a <br />nonprofit corporation, without notice or appraisal, for the real property identified as Tax Map <br />Key (3) 7-5-008:027. <br />
