RE: William Silva, et al., v. County of Hawaii, et al., Civil No. 97-622 (Hilo),
Request for Executive Session
Dear Chairperson Arakaki and Council Members:
The purpose of this letter is to respectfully request the Council place on its next agenda this
Request for Special Counsel. The Honorable Justice Robert G. Klein, Associate Justice of the
Hawaii State Supreme Court, retired, would like to brief the Council on the merits of the County's
appeal concerning the constitutional issue based on the Konno decision. Because the appellate
strategy of the attorneys representing the County will be disclosed, this matter should only be
discussed in Executive Session.
