Your Policy Committee on Public Works and Mass Transit, to which was referred Bill No. 10,
reports as follows:
Bill No. 10, introduced by Council Chairperson. Dr. Holeka Goro Inaba, via Communication
No. 38, dated November 25, 2024, amends Chapter 22, Article 3, Division 2, Section 22-3.3.2, of
the Hawaii County Code 1983 (2016 Edition, as amended), relating to allowable areas for
special activity permits.
Bill No. 10 proposed to allow for authorized commercial activities to be conducted at Ane
Keohokalole Highway, makai side, between Palani Road and Kealakehe Parkway in Kona.

Council Chairperson Inaba explained that Bill 10 inserts a portion of the Ane Keohokalole
Highway, specifically from the southern point of Kealakehe Parkway, to fall in line with the
process set forth in the County Code for where authorized commercial activities may take place.
Pursuant to Section 22-3.3.1 of the County Code, the Committee referred Bill 10 to the Chief of
Police and Director of Public Works for their respective recommendations.
Council Member Heather Kimball sought clarity on which entity is responsible for drafting and
submitting the request for recommendations to departments and suggested that it should be the
introducer. Council Chairperson agreed and indicated that his office would handle the request.
Bill 10 was postponed to February 18, 2025, with eight "ayes", with Committee Member Matt
Kaneali`i-Kleinfelder absent.

Council Chairperson Inaba advised the Committee that he met with representatives of the
Hawaii Police Department and Department of Public Works, separately then together, and
worked on an agreed -upon amendment that resulted in the transmittal of Communication. 38.1.
The amendment adjusts the area within which authorized commercial activities would be
allowed at Ane Keohokalole Highway between the West Hawaii Civic Center and the "Allied
Quarry" access road.

Assistant Police Chief Sherry Bird and Director of Public Works Hugh Ono were present and
confirmed that they supported the amendment. Council Chairperson Inaba stated that formal
letters from both Departments will be submitted to Council.
By a vote of nine "ayes", Bill 10 was amended with the contents of Communication 38.1.
Committee Member Onishi asked if Public Works will cover maintenance needs for the
authorized areas related to these types of legislation, and Director Ono confirmed that the
Department will address this.
Your Policy Committee on. Public Works and Mass Transit is in accord with the purpose and
intent of Bill No. 10, as amended to Draft 2, and recommends its passage on first reading.
