SUBJECT: Proposed Amendment to Bill No. 24, Draft 2; AN ORDINANCE AMENDING
CHAPTER 25, ARTICLES 1, 2, 4, 5, AND 7, OF THE HAWAI`I COUNTY
CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO
TELECOMMUNICATION ANTENNAS AND TOWERS.
Transmitted herewith is a proposed amendment to Bill No. 24, Draft 2. The amendment is shown
below in Ramseyer format with respect to the content of Bill No. 24, Draft 2; material to be
added is underscored.
SECTION 5 of Bill No. 24, Draft 2, which amends chapter 25, article 2, division 7, section 25-2-
74, of the Hawaii County Code 1983 (2016 Edition, as amended), is amended by designating the
contents thereof as subsection (b) and by adding a subsection to be appropriately inserted and to
read as follows:
"(a) The form of an application for elan approval for a telecommunication antenna or
tower must state that in accordance with section 25-7-76 if the director fails to take
action on the application within sixty days after the filing of all application
requirements under subsection (b), the application shall be deemed approved."
A copy of the new draft of Bill No. 24, Draft 2, that would result if this proposed amendment
were adopted is not attached, due to the limited scope of the amendment.
