Aloha Councilmembers,
Please vote down Resolution 74
Council has discussed adding language to the resolution to mitigate any negative impacts of the MOU. But that may not
work if we come under pressure from the Federal government, or if we have changes in leadership in the County
administration.
In any case, information about what exactly is in Resolution 74 has not been made available to the public six calendar days
before this meeting, which may be a Sunshine Law violation.
The MOU re. designation of police employees as customs officers says police will "perform the duties as noted on ... ICE
Form 73-001... This form is attached and is hereby made part of this MOU."

But Form 73-001 is not attached. I sent formal information requests to the County Council office, who says they don't
have it, and to the Police Department, who has not yet responded.
I found Form 73-001 for another jurisdiction online.* But it has check boxes, and we don't know which ones are checked
off for Hawai'i County.
One checkbox says "Perform other law enforcement duties which may be authorized under 19 U.S.C. § 1589a"--which
says "...an officer of the customs may ... perform any other law enforcement duty that the Secretary of the Treasury may
designate." Under a Secretary chosen by the Trump administration, the results could be horrific.
Another checkbox allows police to "Execute and serve orders, search warrants, arrest warrants, subpoenas, summonses,
and other processes issued under the authority of the United States, in accordance with laws administered and/or
enforced by HSI." [underline added]
There is also an "Other endorsements and restrictions" section where anything can be written in.
