Subject: Opposition to Resolution 74-25
I oppose MOU #1 because it:
1) requires the Local Hawai'i Police Department and county taxpayers to provide a secured
space within their facilities for HSI Special Agents and their associated equipment at no
cost to HSI,
2) requires the local HPD to authorize HSI Special Agents to utilize and
communicate over Local HPD-designated UHF/VHF radio frequencies,
3) gives HSI the sole authority to determine the number of personnel and type of resources
it will embed within the Local HPD,
4) requires the Local HPD to cooperate with anyfederaL investigation related to the MOU to
the full extent of its available powers, despite any undue burden this may place upon
Local HPD resources and personnel, and
5) requires HSI to receive Legal guidance from the ICE Office of the Principal Legal Advisor
and the U.S. Attorney's Office at a time when there is an increasing number of Lawsuits
against DNS and federal court findings that DHS has committed illegal and
unconstitutional actions.
I am concerned that we the people of Hawaii Island will lose precious manpower of already
stretched thin police. Violent Crimes are up and it has not been budgeted to take on federal
immigration enforcement.
Please vote "no" on Resolution 74-25 or, at least defer it.
