The Planning Commission, after a duly held public hearing on March 17, 2000, voted to
recommend for your approval the proposed legislative bill to change the district classification
for approximately 19,724 squaze feet of land from Single Family Residential (RS-10) to
General Commercial (CG-7.5). The property is located at the northwest corner of the Kinoole
Street-Wailoa Street intersection, across the former Sun Sun Lau Restaurant, Waiakea, South
Hilo, Hawaii.
The Commission concurs with the following Planning Director's reasons for recommending
favorable consideration of the change of zone:
The request for a change of zone designation from a Single Family Residential
(RS-10) to General Commercial (CG-7.5) would allow general commercial uses on the
subject property. As permitted under Use Permit No. 23, the applicant, a physician,
has retired from his practice due to a vaziety of physical ailments, and would like the
flexibility to expand the use of his property to include general commercial uses as well
as doctor's offices.

In order to consider an area for any type of zoning designation, the applicable
goals, policies and standazds of the General Plan must be adequately addressed. It is
only through such a comprehensive policy analysis approach that evaluations and
decisions can be made to better time and stage developments to achieve growth
determined by the General Plan and related planning documents. The implications of
these evaluations and decisions must be also considered as they may have an impact on
similar areas in the County, but ultimately, on the future development of the whole
island.
The approval of this request would be in keeping with the following goals,
policies and standards of the General Plan:
Economic Element
* Provide residents with opportunities to improve their quality of life.
* Economic development and improvement shall be in balance with the physical
and social environments of the island of Hawaii.
* The County of Hawaii shall strive for diversity and stability in its economic
system.
* The County shall provide an economic environment which allows new,
expanded, or improved economic opportunities that are compatible with the
County's natural and social environment.
* The County of Hawaii shall strive for an economic climate which provides its
residents an opportunity for choice of occupation.
Innd Use Element
* Designate and allocate land uses in appropriate proportions and mix and in
keeping with the social, cultural and physical environments of the County.
* Zone urban- and rural-types of uses in azeas with ease of access to community
services and employment centers and with adequate public utilities and
facilities.

* Allocate appropriate requested zoning in accordance with the existing or
projected needs of neighborhood, community, region and County.
* The County shall encourage the development and maintenance of communities
meeting the needs of its residents in balance with the physical and social
environment.
* Zoning requests shall be reviewed with respect to General Plan designation,
district goals, regional plans, State Land Use District, compatibility with
adjacent zoned uses, availability of public services and utilities, access and
public need.
Commercial Element
* Provide for commercial developments that maximize convenience to users.
* Distribution of commercial areas shall be such as to best meet the demands of
neighborhood, community and regional needs.
* The development of commercial facilities should be designed to fit into the
locale with minimal intrusion while providing the desired services. Appropriate
infrastructure and design concerns shall be incorporated into the review of such
developments.
* Commercial development shall be located in areas adequately served by
transportation, utilities, and other amenities. Commercial developments shall
provide for adequate internal circulation amongst commercial facilities in the
area.
In the General Plan, a Course of Action for commercial development within the
South Hilo District recommends that "appropriately located commercial zoned lands
shall be allocated as the need arises." This request would be consistent with the urban
form depicted for Hilo in that it would add commercial uses serving the entire City of
Hilo and its surrounding region in close proximity to other similar commercial zoned
districts and activities.
The General Plan also provides the concept of mixed use zones to allow
compatible commercial uses to mix with residential uses. Such mixed use zones are
appropriate in areas of economic transition, such as older residential areas which are

needed as sites for more intensive development and light industrial azeas which are in
demand as sites for commercial uses. The Land Use Pattern Allocation Guide
(LUPAG) Map component of the General Plan represents the document's goals,
policies, standazds and courses of action to guide the coordinated growth and
development of the County. It reflects a graphic depiction of the spatial relationships
among various land uses and the expressed policy statements of the document itself.
The LUPAG Map, in essence, establishes the basic land use pattern for areas within the
County.
The subject rezoning action conforms to the LUPAG Map which designates the
azea for High Density Urban Development. This designation allows for commercial,
multiple residential and related services (general and office commercial, multiple
residential). As such, this request conforms with the LUPAG Map. The applicant is
requesting the change of zone to allow a variety of general commercial uses on the
property. On December 19, 1984, the Planning Commission approved Use Permit
No. 23 for a doctor's office. Subsequently, on December 13, 1990, the Planning
Commission approved an amendment to Condition No. 4 (restriction to two doctors) to
lift the restriction on the number of doctors allowed to practice on the site. The
rezoning reclassification would be a reasonable expansion of commercial activities
associated with this designation and the existing commercial uses in the area. The
surrounding properties consist of a mix of residential and commercial uses. The
former Sun Sun Lau Restaurant is located across the street from the property. The
existing access is from Kinoole Street, a County roadway with a 40-foot pavement
within a 60-foot right-of-way. The property is relatively level, landscaped, and
improved upon with an approximately 4,400 squaze foot one-story building containing
four office spaces, and a 26-lot parking area. The property is landscaped to minimize
visual impacts to the adjacent properties.
The project site is situated within close proximity to schools, commercial areas,
employment centers and public safety services. The Hilo Community Development
Plan adopted by Resolution in 1975 by the Planning Commission recommended that the
area be retained as RD-3.75. However, there has been increasing demand for
additional commercial-zoned lands in the area. This area has gradually been in
transition from residential to commercial. Surrounding lands are zoned Single Family
Residential (RS-10) and General Commercial (CG-7.5) and include single family
dwellings and commercial uses. Northeast on Kinoole Street approximately 200 feet
from the subject property are parcels zoned CG-20, site of Farm Credit Service of
Hawaii and Furnitureland. Hawaiian Linen Supply (dry cleaners) and 7-11 store are
located approximately 630 feet from the property and zoned CG-7.5. Other

commercial areas include St. Joseph's School, United Community Church and
Kapiolani Elementary School. Recent commercial rezonings in the vicinity include:
• TMK: 2-2-I8: 37 (REZ 339), site of Furnitureland, from RS-10 to CG-20 by
Ordinance No. 79 474 effective 9/24/79.
• TMK: 2-2-18: 33 (REZ 404), site of Farm Credit Service of Hawaii from
RS-10 to CG-20 by Ordinance No. 82 759 effective 2/22/82.
The proposed change of zone would, therefore, complement the existing
commercial land uses, be consistent with the transition from residential to commercial
occurring in the immediate vicinity and provide for an orderly commercial development
of the area. The project site is located less than one mile from the Hilo urban center
where police, fire and emergency medical services are available.
All utilities and services are or will be made available to the project site which
are essential to accommodate urban development. Access to the property is from
Kinoole Street, a County owned roadway with a 40-foot pavement within a 60-foot
right-of-way. The Department of Public Works recommends that the applicant remove
the existing non-conforming abandoned driveway on Kinoole Street located 15 feet
north of the existing parking lot driveway. The department also recommends that a
concrete sidewalk be constructed in its place in accordance with Chapter 22, Streets
and Sidewalks, of the Hawaii County Code. It is not anticipated that the request to
expand the use will create a significant increase in traffic at the site. According to the
Department of Water Supply, water is available to the site. All other utilities and
services are available to the site.
The project has no severe geological or topographical problems which cannot be
properly rectified or which would render the land unusable. The subject property is
located on the corner of Kinoole Street and Wailoa Street across from the former Sun
Sun Lau Restaurant. The property is rectangular in shape, and the topography is
slightly sloping from north to south. According to the Flood Insurance Rate Map
(FIRM), it is within Zone C, an area of minimal flooding. The subject property is also
located outside of any tsunami inundation area. Any new construction or
improvements to the project area must comply with Chapter 27 of the County Code
relating to Flood Hazard Control. The site has been previously developed and
therefore, no endangered or threatened species of floral or fauna nor any archaeological
sites are anticipated to be found on the properties.

Based on the above findings, this request for a Change of Zone from a Single
Family Residential (RS-10) to a General Commercial (CG-7.5) zoned district would
result in an appropriate land use pattern that will further benefit the general public.
For your favorable consideration, an amendment to Section 25-8-33, the City of Hilo Zone
Map, of the County Zoning Code is transmitted.

THOMAS C. CHEN is requesting a Change of Zone by changing the district
classification from Single Family Residential (RS-10) to General Commercial (CG-7.5) for
approximately 19,724 square feet of land. The property is located at the northwest corner of the

GENERAL INFORMATION
1. Land Ownership: The property is owned by Thomas C. and Jean J. Chen.
APPLICANT'S REQUEST
2. Use Permit No. 23: On December 19, 1984, the Planning Commission approved Use
Permit No. 23 for a doctor's office. On December 13, 1990, the Planning Commission
approved an amendment to Condition No. 4 (restriction to two doctors) to lifr the
restriction on the number of doctors allowed to practice on the site. Condition No. 4
which stated "The doctor's office shall be used by a maximum of 2 doctors and the staff.
The word "staff' shall not be construed to include other medical doctors", was deleted in
its entirety. (See Exhibit A -Planning Commission's letters dated December 19,
1984 and December 13, 1990)
3. Request: The applicant is requesting the change of zone to allow general commercial
uses on the subject property. As permitted under Use Permit No. 23, the property is
currently the site of four doctoi s offices. The applicant, a physician, has retired from his
practice due to a variety of physical ailments, and would like the flexibility to expand the
use of his property to include general commercial uses as well as doctor's offices.

5. SLU: Urban.
6. GP Consistency: Economic, Land Use and Commercial Elements.
7. GP LUPAG Map: High Density Urban. This designation allows for commercial,
multiple residential and related services (general and office commercial, multiple
residential). As such, this request conforms with the GP LUPAG Map.
8. Hilo Community Development Plan (CDP): The Hilo CDP adopted by Resolution in
1975 by the Planning Commission recommended the area for a Double Family
Residential - 3,750 square foot (RD-3.75) zoning.
9. County Zoning: Single Family Residential (RS-10).
10. SMA: The subject property is not located within the Special Management Area.
DESCRIPTION OF PROPERTY AND SURROUNDING AREAS
1 I. Subject Property: The subject property is located on the comer of Kinoole Street and
Wailoa Street, across from the former Sun Sun Lau Restaurant. The property is relatively
level, landscaped, and improved upon with an approximately 4,400 square foot one-story
building containing four office spaces, and a 26-lot parking area.
12. ALISH: Urban Development.
13. FIRM: Zone "C", area of minimal flooding.
14. U.S.D.A. Soil Type: Keaukaha extremely rocky muck, 6 to 20 percent (rKFD), which
consists ofwell-drained, thin organic soils overlying pahoehoe lava bedrock. Runoff is
medium and the erosion hazard is slight.
15. Land Study Bureau Soil Rating: Urban.
16. Archaeological Resources: Since the site has previously been improved, the likelihood
of any archaeological features is remote.
17. Flora and Fauna: The site was previously developed, therefore, impacts to flora and
fauna are expected to be minimal.
18. Surrounding Zoning and Land Uses: There are dwellings on the adjacent parcels to
the west and south. Surrounding parcels are zoned RS-10 and CG-7.5 and in residential
and commercial uses. Northeast on Kinoole Street approximately 200 feet from the
subject property are parcels zoned CG-20, site of Fann Credit Service of Hawaii and
Furnitureland. Hawaiian Linen Supply (dry cleaners) and 7-11 are located approximately
630 feet from the property and zoned CG-7.5. Other commercial uses in the area include
St. Joseph's School, United Community Church and Kapiolani Elementazy School.

effective date of the Use Permit.
3. Construction shall continence within one year from the date
of receipt of Final Plan Approval- and be completed within

of adverse visual impacts through the appropriate siting,
height, bulk, color schemes, signuge and landscaping.
8. All other applicable rules, regulations, and requirements
shall be complied with.
9. Should the Planning Department determine that any of the
foregoing conditions have not been met or substantially
complied with in a timely fashion, the Use Permit shall be
void.

The Planning Commission at its duly held public hearing on
November 29, 1990, voted to approve your request to amend
Condition No. 4 (Restriction of two doctors) of Use Permit No. 23
which allowed the establishment of doctors' offices on 19,724
square feet of land situated within the Single Family
Residential - 10,000 square foot (RS-10) zoned district at
Waiakea, South Hilo, Hawaii.
Approval of this request is based on the following:
The lifting of the restriction on doctors will be
consistent with the intent and purpose of the Zoning Code and
the County General Plan. The medical office has already been
established on property designated "Urban" by the State Land
Use Commission and situated within the County zoned Single
Family Residential zone district. It is felt that even
without limiting the number of doctors who utilize the
facility, the project at this particular location would still
maintain the present environment of this area of Hilo. The
property is located in close proximity to existing commercial
establishments in the area as well as the commercial core of
Hilo. Expanding the medical office facility at this site
would provide an essential and convenient service to those
employed within downtown Hilo as well as the surrounding
residential areas. Therefore, the granting of this request
would also be in the direction of fulfilling a policy of the
General Plan in which "The County shall encourage the
development and maintenance of communities meeting the needs

of its residents in balance with the physical and social

The proposed use will not be materially detrimental to
the public welfare nor cause substantial adverse impact to
the community's character or to surrounding properties.

store, service station, convenience store, dry cleaner and
schools are other uses located in close proximity to the
subject property. By lifting the restriction on the number
of doctors, the limiting factor will be the ability to
provide adequate on-site parking for the facility. As stated
previously, this area in the City of Hilo is considered to be
an expansion of the commercial core.
The granting of the proposed use will not adversely
affect similar or related existing uses within the
surrounding area, community or region. The expansion of this
medical office would offer a broader range of medical care to
the residents of the region and is not expected to adversely
affect existing medical establishments.
The expansion of this medical office facility will not
unreasonably burden public agencies to provide roads and
streets, sewer, water, drainage, schools, police and fire
protection and other related infrastructure. The property is
provided with all essential utilities and services.
Commenting agencies had no objections to the proposed
development.

Approval for the expansion of the medical office
facility shall be secured within one year from the
effective date of this amendment. Plans shall include
all existing and proposed structures, parking associated
with the development, landscaping and the total number
of doctors and staff utilizing the proposed facility.
To assure adequate time for plan approval review and in
accordance with Chapter 25-244 (Zoning Code), plans
shall be submitted a minimum of forty-five days prior to
the date by which plan approval must be secured.
3. Construction shall commence within one year from the
date of receipt of Final Plan Approval and be completed
within two years thereafter;

doctors and the staff. The word "staff" shall not be
construed to include other medical doctors.]

20. Social settlement pattern for the area: Commercial zoneU properties extend
southerly toward the University of Hawaii-Hilo, about 1 mile away on both sides of
Kinoole Street. Formerly the largest restaurant in the city ,Sun Sun Lau
is situated across the street from this subject property. Within a 500 ft. radius are the
largest commercial laundry, the largest retail furniture store, a private school, a
public school, a church, a service station, a convenience retail store. Commercial
zoning has continuously been granted by the County toward the University.
Adjacent and to the west, public housing development will soon at least double that
density. Enlargement to the infrastructure(waterline improvement) will further
justify this proposed zoning, as will Sun Sun Lau's conversion to a nursing/ elderly
care home, according to the fire department.
21. Economic resources of the area: This property well serves the community as the
doctors' office it has become under the Use Permit #23 as amended. It is also suited
to a wider variety of commercial uses with its location and its being supported by
adequate infrastructures( streets, water, sewer, growing populace) and other retail
commercial developments' expansion south along Kinoole street.
22. Land Value-- Tax assesment value has increased from $53155
to $295900 for the period 1983 to 1999, according to tax record.

33.Relationship between local short term use of environment and maintainance of
long term productivity
This immediate area has, since the mid-1960's (development of Sun Sun Lau
restaurant) gradually seen a change from strictly residential to a mix of commericial
uses. Unless logical and natural growth is prevented, the advent of sewerlines and
the establishment and rapid growth of the University, along with the traffic control
signals and related street improvements actually invites growth in the form of
commercial use of property. Residential use is usually the immediate utilization of
urban property with commercial use usually being the culmination of progress.
34. Mitigative measures- A reversion of this azea to agricultural use would prevent
its urbanization ,but this property's location and existing building would render this
an illogical move. The property is not anymore on the fringe of commercial
development. It fills up the enlarged core of the city which has reached the
University.
35.Alternatives-- As mentioned above, the azea could revert to residential or
agriculture use, but it would be a waste of existing building and pazking. It is
already surrounded by commercial and high density use. Residences are moving
away from the main street to quieter areas. Only in Panaewa and upper Waiakea are
there significant agriculture uses in South Hilo.
36. Irreversible and irritrievable commitments:
This 19,724 sq. ft. parcel has been practically converted to a commercial
doctors' offices) through a Use Permit granted originally in 1984, amended in 1990.
There has been no negative reaction. In fact, my patients have been very pleased by
the spaciousness of my office and the ample on site parking which this property has
afforded, as compared with my previous space (old Hilo Hotel There is no on
site depletion of natural resources that would occur from this "progressive
rezoning". Certainly there could be an increase in the use of building material

a. Public works- On Nov.16, 1999, briefly discussed the prc,~,osal with Mr. Kelly
Domes, engineer. He informally states he saw no significant problem
with rezoning in as much as the right of way (Kinoole) seems adequate, and the
present use under Use Permit #23) has undergone similiar scrutiny by their
department.
b. Department of Water Supply - On Nov. 16, 1999, briefly discussed the proposal
with engineer Mr. Keith Okamoto. He also informally stated he saw no problems
with rezoning (see Fire Dept. comments) and the potable water supply.
c. Police - By telephone, their response was that Traffic Service, Patrol and
Administrative sections would be asked for their respective comments when the
application is reviewed by them
d. Fire - By telephone, Mr. Richard Kihara, inspector, on Nov. 18, 1999, responded
that new nearby developments, akeady approved, show that the water system will
undergo "looping "and other improvements, thereby increase the pressure and flow
to the fire hydrants in the vicinity. The Sun Sun Lau restaurant conversion (to an
elderly or nursing home facility) and the multi-million dollar Hawaii Housing
redevelopment (4-plex construction) will fiirther support the rezoning of this
parcel.

8-inch waterline along Kinoole Street which fronts the property with a connection size subject to
review and approval during the construction design phase of the proposed development. The
parcel is currently serviced by a 5/8-inch meter which is restricted to a daily maximum of
600 gallons.
We would require that the applicant do the following:
I. Consult with the Fire Department for any fire protection requirements. The existing 8-inch
waterline has a theoretical fire-flow capacity of 1,500 gallons per minute. The nearest fire
hydrant is approximately 70 feet from the corner of the property at the intersection of
Kinoole Street and Wailoa Street.
2. Before the Department can issue a water commitment, the applicant should submit the
following:
a. the anticipated maximum daily water usage as recommended by a registered
engineer. The Department reserves the right to make a final determination, and
b. a water commitment deposit must be remitted in accordance with the Department's
Water Commitment Guidelines Policy, a copy of which is attached to the applicant's
copy of this memo. The applicant will be informed of the deposit amount upon final
determination of the submittal required in Item 2a.

Upon completion of item Nos. 2a and 2b on Page 1, an official water commitment will be effected
in accordance with the Water Commitment Guidelines Policy. The commitment will be in writing
with specific conditions and effective dates stated.
The applicant needs to keep in mind that this Letter shall not be construed as a water commitn~ierrt
In other words, unless a water commitment is officially effected, water availability is subject to
change depending on the water situation.

commitment deposit. Based on your present usage of 250 gallons per day as disclosed in your
letter and no additional requirements, the existing 5/8-inch meter is adequate and a water
commitment deposit is not necessary. Therefore, we are returning your check.
Finally, based on documentation on water usage and the satisfaction on the fire protection
requirements, we have no additional requirements and have no objections to the change of zone
being granted. The Planning Department will be informed of this through a copy of this letter.
