HomeMy WebLinkAboutRES 142 Draft 01 2024-2026A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAI‘I’S DEPARTMENT OF TRANSPORTATION AS WELL AS GRANT A REAL PROPERTY LICENSE OR PERMIT
FOR THEIR INSTALLATION AND UPKEEP OF NATIONAL ELECTRIC VEHICLE INFRASTRUCTURE SYSTEMS AT VARIOUS COUNTY OF HAWAIʻI PROPERTIES.
WHEREAS, Hawaiʻi Revised Statutes Section 46-7 requires the County to obtain consent of the Council to enter into agreements with the federal or state governments respecting action to
be taken pursuant to any of the powers granted by law to furnish, expend, and receive any funds or other assistance in connection with projects being or to be undertaken pursuant to
those powers; and
WHEREAS, Hawaiʻi County Code Section 2-120(a)(4) requires the County to obtain consent of the Council to grant a real property license or permit to governments and governmental agencies;
and
WHEREAS, the Department of Parks and Recreation, the Department of Public Works, and the Hawaiʻi Police Department desire the ability to enter into an Memorandum of Agreement with the
State of Hawai‘i’s Department of Transportation (“DOT”) that allows DOT to install and maintain National Electric Vehicle Infrastructure (“NEVI”) Charging Stations at each of the following
sites: Hoʻolulu Complex, West Hawai‘i Civic Center, and the Waimea Civic Center; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that in accordance with Hawai‘i Revised Statutes Section 46-7 and Hawai‘i County Code Section 2-120(a)(4), the Mayor, on behalf
of the County of Hawai‘i, is authorized to execute an
intergovernmental agreement with the Department of Transportation, on such terms and conditions as deemed proper, for the purpose of installing and maintaining NEVI Charging Stations
at each of the following properties: Ho‘olulu Complex, West Hawai‘i Civic Center, and the Waimea Civic Center.
BE IT FINALLY RESOLVED that the County Clerk of the County of Hawaiʻi shall transmit copies of this resolution to the Office of Management, the Finance Department, the Department of
Parks and Recreation, the Department of Public Works, and the Hawai‘i Police Department.
