Aloha mai Chair Inaba and members of the Hawaii county council,
It is now very clear that the current federal Administration is now taking lawless actions in violation of the
constitutional rights of legal residents and citizens of the United States of America.
The Department of Homeland Security has illegally kidnapped a legal resident of the U.S. and transferred
him to a foreign private prison in El Salvador for life. It is well -documented that the inmates in this
private prison are subjected to torture, abuse, and isolation from their families and legal representation.
The U.S. Supreme Court ruled in an unanimous decision that the Administration must facilitate the return
of this man in order and follow the Fifth Amendment guaranteeing due process to all persons within the
borders of the U.S.
During a press conference in the Oval Office on Monday, the U.S. president stated that he will not follow
the Supreme Court's order to return the legal American resident. The president of El Salvador stated he
will not return the American resident. The U.S. Attorney General then made patently false and
defamatory statements about the American resident in an apparent attempt to provide political cover for
defiance of the Supreme Court order and the U.S. Constitution.
Given the increasing lawlessness against citizens and legal resident, as well as intimidation and extortion
of the American free press, law firms, and American universities, it is time for this council to accept the
reality that the Administration has become authoritarian and dictatorial.
It is imperative that the county council take every opportunity to protect and serve the health, safety, and
welfare and ensure that the Fifth Amendment rights as well as all other constitutional rights of the
residents of this county are protected.
There is already an agreement between the FBI and the county Hawaii Police Department.
Please defer approval of RES 104-25, until such time that the federal Administration has begun to comply
with court orders and ceased unconstitutional acts against the rights of Hawai'i county residents.
