COUNTY OF HAWAI'I STATE OF HAWAI'I <br /> RESOLUTION NO. 187 25 <br /> A RESOLUTION AUTHORIZING THE GRANT OF A GAS TANK AND PIPELINE <br /> EASEMENT, UNDER A PORTION OF KAWAILANI FIRE STATION AND HILO <br /> MUNICIPAL GOLF COURSE,IDENTIFIED AS TAX MAP KEY NOS.: (3)2-4-002-001 <br /> & 2-4-002-128, SITUATED AT WAIAKEA, SOUTH HILO, COUNTY AND STATE OF <br /> HAWAI`I. <br /> WHEREAS, the State of Hawai`i set aside to the County of Hawai`i ("County")pursuant <br /> to Executive Order 1223 the real property identified as Tax Map Key (3) 2-4-002-001 and to <br /> Executive Order 1641 the real property identified as Tax Map Key 2-4-002-128, which are <br /> portions of the Hilo Municipal Golf Course and the Kawailani Fire Station Site, respectively, <br /> situated at Waiakea, South Hilo, County and State of Hawai`i; and <br /> WHEREAS, THE GAS COMPANY, LLC operates a propane utility gas system serving <br /> the community in the Waiakea area; and <br /> WHEREAS, THE GAS COMPANY, LLC currently has a propane utility gas tank <br /> located on and underground pipelines that run underneath the portions of the Kawailani Fire <br /> Station Site and the Hilo Municipal Golf Course; and <br /> WHEREAS,the County would like to grant THE GAS COMPANY, LLC an easement <br /> to use the easement areas identified in Exhibit A for tank and underground pipeline purposes; <br /> and <br /> WHEREAS,pursuant to section 2-111(2) of the Hawai`i County Code,the Council is <br /> authorized to direct the Finance Director or the Director of Public Works to grant easements for <br /> particular purposes, subject to reverter to the County upon termination or abandonment of the <br /> specific purpose for which it was granted; and <br /> WHEREAS, due to the circumstances presented above,there are substantial reasons to <br /> grant THE GAS COMPANY, LLC tank easement Easement T and underground pipeline <br /> easements Easement UP-1 and Easement UP-2, more particularly described in Exhibit A through <br /> direct negotiation; now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, <br /> pursuant to section 2-111 of the Hawai`i County Code,the Finance Director or the Director of <br />
