Chen Subject: Condition B (Removal of Existing Abandoned Driveway) Tax Maa Kev• 2-2-20: 11 This is in response to a conversation between yourself and Susan Gagorik of our staff on July 3, 2000, concerning compliance with Condition B of your ordinance. Condition B states as follows: "B. The existing non-conforming abandoned driveway on Kinoole Street shall be removed and a concrete sidewalk constructed in its place, meeting with the approval of the Department of Public Works. The improvements shall be completed within five (5) years from the effective date of this ordinance." A previous letter to you from our department dated June 22, 2000, stated that these improvements needed to be completed before you establish any commercial uses on the subject property. After further review of the ordinance, we have determined otherwise. Your building was fully operational since you secured a Use Permit for doctors' office in 1984. Condition B of Ordinance No. 00-061 does not state any limitations or timeframe for ; establishing commercial uses on the property, therefore, we see no reason for restricting the establishment of commercial activity on the subject property. Page 2 July 3, 2000 You may proceed with these uses as you desire, keeping in mind that the existing abandoned driveway shall be removed within five (5) years from the effective date of this ordinance or by May 23, 2005. We will comply with the conditions attached to the approval. The existing building is ready for use. We are very grateful for the help from Ms. Phyllis Fujimoto, Ms. Susan Gagorik and Mr. Donald Tong . Before we establish the property to general commercial use, is there anything we should do?
