Due to time constraints and lack of information about Ms.Ayers, I did not provide testimony at that time. However,after watching the video of the committee meeting and reviewing Ms.Ayers business interests, I am compelled to write in opposition to the confirmation for a five-year term to the Leeward Planning Commission (LPC). This is primarily because of: 1) a severe lack of necessary prerequisite knowledge and experience to enable understanding of the complex legal issues involving applications and/or agenda items that come before the LPC and to make independently informed decisions, and 2) potential conflicts of interests with agenda items coming before the LPC as an agent of the real estate firm, Luxury Properties, LLC. https://luxurvpropertieshawaiillc.com/team This position is not taken lightly because it is clear to all that Ms.Ayers is of outstanding character, has excelled in all her life's endeavors, and is an exemplary community volunteer and parent. She definitively fits the demographic and our county's needs for young, local residents to "step up to the plate"and volunteer their time, energy, knowledge,and expertise to serve on our Boards and Commissions. I admire, respect, and acknowledge her willingness to put forth the time and effort necessary to serve on our county's Boards and Commissions. It is for the aforementioned reasons that I would hope that Ms.Ayers would allow her application to be withdrawn and to have her application submitted to serve on the Kona Community Development Plan Action Committee (Kona CDP AC). Ms.Ayers would be doing the Kona community a great service because the Kona CDP AC is currently in a dire situation with 5 vacancies listed for that 9-member Committee. In addition,the Kona CDP AC would be the most appropriate and advantageous volunteer position for her"on-the-job training"with county planning. Comm. Ref. To: 11 1![�1.i 1 Ref. Date . 1Y. - 7 2025 The reason for this suggestion is that the Planning Commission is not a county planning educational institution. It is an administrative institution with broad and powerful discretionary authority and influence. Planning Commissioners are presented with complex applications that oftentimes involve county,state, and federal law and millions of dollars. They are expected to represent the interests of their communities in an effective manner, independent of special interests. Commissioners are expected to be able to have the expertise, knowledge,and ability to consider and discuss the Background Reports and Recommendations of the Planning Director independently of the county administration, Planning Director,and/or special interests. This means that sometimes very difficult,yet fair and balanced, decisions must be made to change or sometimes deny applications that come before the Commission. Further, nominees for the Planning Commission should have a working knowledge and/or prior experience with: 1) their district's Community Development Plan, 2) the General Plan or the GP Comprehensive Review that has been on-going since 2015, 3) public access, including historic trails protected under the Highways Act of 1892,and 4) cultural and environmental resources law and protections,such as archaeological preservation plans and associated property easements, burial treatment plans necessary to protect iwi kupuna, and cultural impact assessments necessary to protect and preserve traditional and customary practices of kanaka maoli. The same lack of experience concerns were raised during Commissioner Amando Rodriguez's confirmation hearings,who will be serving through December 31,2027. Is it fair or appropriate for the South Kona community to have another LPC nominee who is essentially a novice to county planning,especially given that South Kona contains significant environmental,cultural, and historic resources and is experiencing an increasing number of large highway-to-coast subdivision developments? For instance, between Honauau and Miloli'I,there are at least four large subdivisions covering over 1,000 acres of coastal land containing significant constitutionally-protected resources being proposed or developed. 1. Mauna 'Oni Properties, LLC/Pali Kai subdivision,388+acres. Letters document legal controversy(see attached April 29,2019 letter from state Office of Conservation and Coastal Lands to Planning Director Michael Yee and July 28,2017 letter from Cades Schutte to Planning Department). 2. Kona 167, LLC, 167acres. The property contains significant archaeological features and cultural resources, including historic trails and likely settlement/village. 3. IDH, LLC/Kona Horizons subdivision,200+acres. The following is quoted from a current listing of lot for sale: Property Description: Kona Horizons consists of premium agricultural properties all of which offer stunning views, private well water metered to each lot, and a gated entrance for privacy and security. Located at Opihihale 16 miles south of Captain Cook. *Private,gated 2 community*Private Well,water metered at each lot*Spectacular views*Five-acre plus, Fee Simple agricultural lots *Elevation ranges from^'900'-1250' *Ocean breezes *Rich regional history and culture" https://www.hawaiiluxurvhomes.com/property/708555/ 4. Kona Estates at Opihihale, 300+acres, proposed luxury resort facing large community opposition. Reference online petition signed by over 5,000 in opposition online at https://www.change.org/p/protect-opihihale-stop-kona-development- partners-now We are all aware of the lack of qualified individuals submitting applications for the county's Boards and Commissions. I'm very appreciative of Executive Assistant to the Mayor, Micah Alameda's coaching and mentorship to prepare Ms.Ayers for the GOEA committee meeting,as well as the on-going efforts of Mayor Alameda and the county council to fill the vacant positions on county Boards and Commissions. But given the current compositional balance of interests and experience on the LPC, I do not believe that it is in the best planning interests of the South Kona community to have an individual representing them who is a real estate agent for a firm that caters to"luxury properties" and lacks appropriate prerequisite county planning knowledge. I hope the county council and/or Ms.Ayers would agree that the best place to start the steep learning curve that is county planning discussions and decision-making would be the Kona CDP AC. In order for the council and community to have a better understanding of potential conflicts of interests, please ask the following questions and determine if it would be appropriate for the Board of Ethics to review in order to establish a clearly understood basis for resolving any potential conflicts of interest. 1. Would Ms.Ayers recuse herself from discussion and/or decision-making for former and current clients who come before the LPC? 2. Would Ms.Ayers recuse herself from discussion and/or decision-making when applications and/or agenda items involve the clients of Luxury Properties Hawai'i, LLC's agents? 3. What is the potential for the team of Luxury Properties LLC real estate agents become an indirect influence on the discussions and decision-making of the LPC? I would like to repeat that fact that I admire and respect this nominee, but believe the Kona CDP AC, not the LPC is the appropriate place for this nominee to serve county Boards and Commissions. The OCCL notes TMK: (3) 8-7-003:001 of which the makai portion of the parcel lies within the Conservation District appears to have been subdivided into nine parcels of which the makai portion of the nine parcels now lie within the Conservation District. Formerly 1 parcel contained Conservation District land and now 9 parcels contain Conservation District land. Pursuant to the Hawaii 'Administrative Rules, §13-5-22 P-10 SUBDIVISION OR CONSOLIDATION OF PROPERTY, subdivision of land that lies within the Conservation District may be applied for ONLY if it serves a public purpose. In fact, Mr. Matsukawa represents developer Lyle Anderson who is trying to force his neighbors to extinguish recorded access easements over property owned by Mr. Anderson(TMK Nos. 8-7-003: 00, 012-014, 016 -023 and 8-7-005: 004 and 027) (see attached map printed from the County GIS)to facilitate Mr.Anderson's future development. Our office represents Peter Dungate,owner of TMK Parcels 8-7-007: 008-011 located in the ahupua'a of Pahoehoe lst to the south and adjacent to Alae 1St. These parcels benefit from a recorded access easement over the parcels owned by Mr. Anderson's company(Mauna'oni Properties LLC) as well as other burdened properties. This access easement is what Mr. Matsukawa refers to as the"North Easement." Contrary to,Mr. Matsukawa's assertions,the North Easement does not"terminate"at the State-owned property. As Mr. Matsukawa is well aware,there is an existing public road across the State-owned property that joins the recorded easement at the south side of the State property. This roadway is identified on maps as "Old Government Road." See attached TMK Maps and Wes Thomas Associates Map Showing Pre-Existing Lots of Record. There is no need for an easement for a member of the public to use a public road over public property. The North Easement provides legal access for emergency vehicles as well as the regular access for benefitted landowners. There will be substantial adverse impacts on public safety and health if access over these easements is in any way impaired. I attach copies of the recorded easements burdening Mr.Anderson's property and benefitting Mr. Dungate's property. Mr.Dungate does not intend to voluntarily extinguish these easements. The County is not a party to these easements and has no jurisdiction to make any declaration or take any legal action relative to these recorded easements nd should refrain from getting involved in Mr. Anderson's scheme.
