RE: Proposed Amendment to Bill No. 39, Draft 2; An Ordinance Amending Chapter
19, Article 1, Section 19-2, and Article 7, Section 19-53, of the Hawai`i County
Code 1983 (2016 Edition, as Amended), Relating to the Affordable Rental
Housing Real Property Tax Classification.
Transmitted herewith is a proposed amendment to Bill No. 39, Draft 2. The amendment is shown
below in Ramseyer format with respect to the content of Bill No. 39,Draft 2; material to be
deleted is bracketed and stricken, and material to be added is underscored. Due to the limited
scope of this amendment, a copy of the new draft of this bill that would result if it were adopted
is not attached.
SECTION 2 of Bill No. 39, Draft 2, which amends chapter 19, article 1, section 19-2, of the
Hawai`i County Code 1983 (2016 Edition, as amended)by amending the definition of
"affordable rental rate", is amended to read as follows:
'Affordable rental rate"means:
(1) Within the United States Postal Service ZIP Code zones 96719, 96725, 96738,
96739, 96740, 96743, and 96745,a monthly rent not to exceed the most recent
affordable rental guidelines for eighty percent of the area median income of
the County as established by the Hawai`i housing finance and development
corporation[.-]; and
(2) Within any other United States Postal Service ZIP Code zone, a monthly rent
not to exceed the average of the most recent affordable rental guidelines for
sixty percent and for eighty percent of the area median income of the County,
as established by the Hawai`i housing finance and development corporation."
