RESOLUTION NO, 193 25 A RESOLUTION ACCEPTING THE DONATION OF REAL PROPERTY IDENTIFIED BY TAX MAP KEY NO. (3) 6-4-006:050,SITUATED AT PU'UKAPU,DISTRICT OF SOUTH KOHALA,ISLAND, COUNTY,AND STATE OF HAWAI`I. WHEREAS, Meril Mulierre Caceres and Lora Taylor De Oliveira(hereinafter"the Owners") own the real property identified by Tax Map Key No. (3) 6-4-006:050 (hereinafter "the subject Property"),being Lot 1-A of Land Patent Grant No. 4661 to John Watt and David Forbes and containing an area of approximately 12,000 square feet, situated at Pu'ukapu, District of South Kohala, Island, County, and State of Hawai`i, as depicted on Exhibit A, attached hereto and made a part hereof; WHEREAS,the Owners wish to donate the subject Property to the County for drainage maintenance purposes; and WHEREAS,the Department of Public Works is willing to accept the subject Property in order to maintain surrounding drainageways and better protect nearby properties, including the Waimea Police Station and Waimea Fire Station located across the street from the subject Property; and WHEREAS, Section 13-12 of the Charter of the County of Hawai`i (hereinafter"the Charter")provides that the Council"on behalf of the county,may accept gifts of donations of money, securities or other personal property or of real estate or any interest in real estate"; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, pursuant to Section 13-12 of the Charter,this body hereby accepts the donation of the subject Property, as hereinabove described and depicted on Exhibit A,by the Owners thereof for drainage maintenance purposes. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable C. Kimo Alameda, Mayor of the County of Hawai`i; Diane T. Nakagawa, Director of Finance;Neil A. Azevedo, Acting Director of Public Works; and Meril Mulierre Caceres and Lora Taylor De Oliveira, 8104 Red Arrow Court, Milwaukee, Wisconsin 53213-3022.
