RESOLUTION NO. 200 25
A RESOLUTION ACCEPTING ALL DONATIONS THAT ARE NOT COVERED BY
THE CAPITALIZATION PROCEDURES OF THE DEPARTMENT OF FINANCE AND
RECEIVED BY THE COUNTY DURING THE FISCAL YEAR ENDING JUNE 30, 2026.
WHEREAS, Section 13-12 of the Charter of the County of Hawai`i (hereinafter"the
Charter")provides that the Council"on behalf of the county, may accept gifts of donations of •
money, securities or other personal property or of real estate or any interest in real estate"; and
WHEREAS, Section 2-162(b) of the Hawai`i County Code provides that a"gift or
donation of money, securities, or personal property not covered by the capitalization procedures
[of the Department of Finance] shall be submitted to the council by letter for its approval"; and
WHEREAS, donations of commodities not covered by the capitalization procedures of
the Department of Finance are made by various entities to the County throughout the year and
are normally accepted by the Council of the County of Hawai`i (hereinafter"the Council") via
letter during a duly noticed meeting of the Council; and
WHEREAS, it is in the best interest of the County and the public that uncapitalized
donations to the County are accepted in an expeditious manner; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that all
donations to the County that are made within the fiscal year ending June 30, 2026 and not
covered by the capitalization procedures of the Department of Finance are hereby deemed
accepted by this body upon receipt of the donation by the County; provided that, at the end of
each quarter, a report of all donations received under the terms of this resolution is submitted to
the Council by the Director of Finance.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to William V. Brilhante, Jr., Managing Director; Renee N. C. Schoen, Corporation
Counsel; and Diane T. Nakagawa, Director of Finance.
