RESOLUTION NO. 202 25
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF LATER FISCAL
YEARS TO ENTER INTO A MULTI-YEAR LEASE AGREEMENT FOR REAL
PROPERTY TO BE USED BY THE DEPARTMENT OF PARKS AND RECREATION.
WHEREAS, Section 10-11 of the Charter of the County of Hawai`i (hereinafter"the
Charter")provides, in part,that"any contract, lease or other obligation requiring the payment of
funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made
or approved by resolution"; and
WHEREAS,the Department of Parks and Recreation(hereinafter"the Department")
wishes to enter into a multi-year lease agreement with Ocean View Community Association,
Inc., with a term of two years commencing July 1, 2025 and ending June 30,2027 and an option
to extend the lease for one more year; and
WHEREAS,the purpose of this agreement is to allow the Department's Elderly
Activities Division use of the Ocean View Community Center, located at 92-8924 Leilani Circle,
Ocean View, Ka`u, for its Adult Nutrition Services Program, from Monday through Friday,
between the hours of 8:00 a.m. and 1:00 p.m.; and
WHEREAS,the Department estimates the monthly cost of this lease agreement to be
$450; and
WHEREAS, approximately 3,200 square feet will be leased under this agreement, which
is significantly larger than the 600-square-foot space previously utilized by the Department; now,
therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that the
Mayor is hereby authorized to enter into a multi-year lease agreement with Ocean View
Community Association,Inc., for the purposes hereinabove described.
BE IT FURTHER RESOLVED that, in accordance with Section 10-11 of the Charter,
sufficient funds be budgeted in later fiscal years to cover the anticipated obligations of the
County under the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Honorable C. Kimo Alameda, Mayor of the County of Hawai`i; Diane T.
Nakagawa, Director of Finance; Clayton S. Honma, Parks and Recreation Director; J S.
Yoshimoto,Assistant Corporation Counsel; and Marilynn B. Rose, President of Ocean View
Community Association, Inc., P.O. Box 6016, Ocean View, HI 96737.
