It requires the planning director to revoke people's registration ( and therefore their livlihood) for any violation of law. This includes: a. Having any unpermitted improvements. This sweeps up 40% of the properties on the Big Island, or nearly 2,600 small businesses. b. Operatingwith a cesspool. The EPA classifies any address with a home based business and a cesspool as a "high capacity" cesspool. These are illegal and can be used as a pretext to shut down the host. c. Operating in Ag zoning. Hawaii Revised Statutes §205-4.5 forbids the use of agricultural zoned land for rentals of less than 21 days. 2. It requires homeowners to disclose their unpermitted improvements while providing them with no protection from prosecution. 3. It fines people $10,000. This fine is ridiculous relative to the impact of failing to register. Once again - intentionally or not, this Bill is a ban on operating hosted rentals on ag land.
