I had the opportunity to watch the video of the May 6, 2025, hearing of the Policy Committee on Planning, Land Use, and Economic Development. Bill No. 47 relating to "Transient Vacation Rentals" was introduced by Council Member Kimball and Council Member Kierkiewicz. The presentation pointed out that these draft TVR provisions would not impact the existing policies adopted in Chapter 25 of the Hawaii County Code related to unhosted Short Term Vacation Rentals. Therefore, it seems that the intent of Bill No. 47 is to establish business operating standards for hosted transient vacation rentals. This draft amendment to Hawaii County Code, Chapter 6, titled "Businesses", proposes to add a new article establishing provisions for an individual operator to register their TVR. It also includes related requirements for enforcement, penalties, cancellation, and the use of hosting platforms. But TVRs are not legally enabled within Chapter 25 of the "Zoning Code," making it premature to consider initiating a program within Chapter 6 dedicated to registering individual TVRs. Therefore it is in the best interests of the County of Hawaii to first introduce legislation proposing the establishment of a Section for Transient Vacation Rentals within Chapter 25 that would address conditions and policies such as permitted land use districts, requirements for use permits, public works requirements, allowable uses, and standards related to the maximum number of rooms dedicated to transient visitor rentals or a maximum number of guests within the principal residence or secondary structure, and parking requirements. Thank you very much for considering my perspective regarding this measure. Respectively, Comm. Nancy Pisicchio Ref, To. - Rd. eaip 2 1 2 225
