A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A FIVE-YEAR
LICENSE AGREEMENT WITH THE TRUSTEES OF THE ESTATE OF BERNICE
PAUAHI BISHOP FOR THE CONTINUED OPERATION AND MAINTENANCE OF A
NON -MANNED COMMUNICATIONS FACILITY WHICH INCLUDES A THREE
HUNDRED FOOT TOWER.
WHEREAS, the Hawaii County Charter Section 10-11 requires that any contract, lease
or other obligation requiring payment of funds from the appropriations of a later fiscal year or of
more than one fiscal year be approved by resolution; and
WHEREAS, the Hawaii County Civil Defense Agency wishes to enter into a License
Agreement with the Trustees of the Estate of Bernice Pauahi Bishop to operate and maintain a
non -manned communications facility which includes a three hundred (300) foot tower; and
WHEREAS, this five (5) year License Agreement will support the Hawaii County Civil
Defense Agency's desire to continue to enter onto and use a portion of the land located in
Keauhou, Ka`u, Hawaii located at Tax Map Key (3) 9-9-001-034 where the Kulani Cone radio
tower and facility is situated and whereby the County has necessary radio equipment installed
which requires regular maintenance; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: that in
accordance with Hawaii County Charter Section 10-11, that the Mayor of the County of Hawaii
is authorized to execute, on behalf of the County, a License Agreement with the Estate of
Bernice Pauahi Bishop for this purpose; and
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years
to cover the anticipated obligations of the County under the terms of the license agreement; and
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Director of Finance,Mayor C. Kimo Alameda,the Hawaii County Civil Defense
Agency, and the Office of Corporation Counsel.
