HomeMy WebLinkAboutRES 215 Draft 01 2024-2026A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A FIVE-YEAR LICENSE AGREEMENT WITH THE TRUSTEES OF THE ESTATE OF BERNICE PAUAHI BISHOP FOR THE CONTINUED OPERATION AND MAINTENANCE OF
A NON-MANNED COMMUNICATIONS FACILITY WHICH INCLUDES A THREE HUNDRED FOOT TOWER.
WHEREAS, the Hawaiʻi County Charter Section 10-11 requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or of
more than one fiscal year be approved by resolution; and
WHEREAS, the Hawaiʻi County Civil Defense Agency wishes to enter into a License Agreement with the Trustees of the Estate of Bernice Pauahi Bishop to operate and maintain a non-manned
communications facility which includes a three hundred (300) foot tower; and
WHEREAS, this five (5) year License Agreement will support the Hawaiʻi County Civil Defense Agency’s desire to continue to enter onto and use a portion of the land located in Keauhou,
Ka‘ū, Hawaiʻi located at Tax Map Key (3) 9-9-001-034 where the Kulani Cone radio tower and facility is situated and whereby the County has necessary radio equipment installed which
requires regular maintenance; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I: that in accordance with Hawai‘i County Charter Section 10-11, that the Mayor of the County of Hawaiʻi is authorized to execute,
on behalf of the County, a License Agreement with the Estate of Bernice Pauahi Bishop for this purpose; and
BE IT FURTHER RESOLVED that sufficient funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the license agreement; and
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Director of Finance, Mayor C. Kimo Alameda, the Hawai‘i County Civil Defense Agency, and
the Office of Corporation Counsel.
